Dramatic development in the fight for the Right to Life and the standing of pro-abortion Catholic politicians.
Today, in EWTN's news magazine The World Over, canon lawyer Marc Balestrieri revealed that the Congregation for the Doctrine of the Faith has certified that the Church's condemnation of abortion is part of Catholic doctrine and of natural law, and as such, any one who publicly contradicts this doctrine is guilty of heresy and incurrs an automatic excommunication.

Earlier this year, Marc Balestrieri filed a heresy lawsuit against Senator John F. Kerry for his public and obstinate support of abortion rights. This lawsuit remains active in the tribunal of the Archdiocese of Boston. Today, Mr. Balestrieri announced in the same program that he will file new charges against the most egregious offenders, including Senator Ted Kennedy (D-Mass) and Susan Collins (R-Maine), whose pro-abortion voting record is well known.

ASSUMING that the Vatican's position is as outlined in the letter above (and that's a good assumption,) the reason that you've not heard this from NBCCBSABCCNN et al is that the Vatican ain't stupid.
Their legate in the US can read the newspapers and knows all about the Demorat "suppression" and other claims; they also know that the Dims would be very happy to claim that the Church interfered with the election and sue everybody in sight for as long as it takes to get Kerry in there.
The Vat doesn't want that any more than you or I do.
In addition, I think the Vat's going to require all the USBishops to send warning letters to CINO pols who support abortion, which is a nicety, but it's 'on paper.' Those CINOs who fail to cooperate with the warning will then be subject to public announcement of their voluntary self-imposed excommunication.

Apply them and voila! Politicians are included if they voted FOR abortion funding.

Kerry's an excommunicandus based on the abortion question alone and likely now regrets deeply having married Teresa, regardless of the validity.

Kerry was "remarried" in 1995 in a civil ceremony. He first filed for an annullment (which has not been granted) in 1997.
Correct--but it's immaterial. His voting record incurs the latae sententiae (and if necessary, the paperwork/formal) excommunication.

The Church discourages capital punishment if the particular state or nation has the resources and the facilities to keep the perp jailed for life.
Now in the case of burning a heretic, it just so happens that the Church does NOT have the facilities to keep the so-and-so jailed for life.

I take it that he did not marry her before a Catholic priest, but rather went to the Lutheran church to do the deed.
sKerry's supporters like to refer to him as "a devout Catholic". He dated Theresa for "a short courtship" before they moved in together. They were later married in a civil ceremony withouth his having obtained an annulment from his first keeper, even though they are relatively easy to buy once a price is settled upon with the church, which they obviously could afford. He sought an annulment not long ago, no doubt for purposes of personal politcal gain.
There are some unknowns here (although I'm perfectly willing to believe that your narration is true.)
We do NOT know if the annulment was granted, unless Kerry, his ex-wife, or a Churchman actually said so on record.
IF the annulment was granted, Kerry could have had his marriage regularized, privately.
Admittedly, this would be something he'd be happy to have "out" unlike his Navy records...
But it's irrelevant. His excommunication is patented based on his heresy and support of abortion.
