August 17, 2004 -- REDWOOD CITY, Calif. — Stunning new phone tapes from Scott Peterson's slay trial yesterday depicted his miffed mistress demanding to know if he slept with wife Laci the night before she vanished — and Peterson insisting he told Laci about their affair after their first date.

Really obsessed. I did my homework and read many of the phone transcripts! What jumps out at me is his willingness/desire to keep talking to her in light of the "grilling". If Amber was just a fling he would have handled her differently. I'm still sticking with what I said earlier. He made a decision long before Amber to "get rid" of his wife and child in some manner. He wanted a "new wife" or partner and Amber was it. I don't think he would have necessarily been faithful to her - I think he just likes to have someone to take care of domestic needs while he has fun "on the side". Laci was probably making demands that would have precluded the aforementioned lifestyle. As always, JMO.

Some of these t.h.s drive me nuts. Lately, I've started watching the court shows (CC, NG) via recording. I have the DVR from Dish Network, so I can record it, and zap past the parts I don't want to watch, which for me is nearly every lawyer who limits him/herself to cliches ("just because he's a cad doesn't mean...").

It seems every teevee t.h. thinks he or she could try the case better than the prosecution--must be a pain being the DA with so many shrill backseat drivers. No doubt they've made mistakes, but then they're not perfect talking heads like these other guys, LOL!

Do you suppose that's why her dad hired someone to keep an eye on her? That came out on one of the CC interviews--not sure when that was. No one ever really said why, although her dad said he "wanted to keep her safe."

Yes, but that doesn't change the fact that he was not undergoing a CUSTODIAL interrogation, and therefore Miranda does not apply.

How many times have you heard of a cellmate being planted in a guy's cell, and the guy tells the cellmate something, and the cellmate testifies against him? Surely that is closer to a custodial interrogation, and yet such evidence is admitted and upheld.

The police know they cannot beat or torture a confession out of someone. Beyond that, it's almost like the sky's the limit. They can definitely lie to a person to goad them into confessing--and it will be upheld in court.

There was a case in which a man hired a hit man to off a judge, and the police set up an elaborate charade in which the "hit man" showed the guy a picture of the judge's "body" in the trunk of a car, to prove that he had done the hit, and to elicit incriminating comments from the man who'd plotted to kill the judge. The judge was actually alive, but was posing as a corpse. The conviction was upheld.

Another point is, this isn't a confession. Scott hasn't explicitly confessed to murder on these tapes. These tapes go to his state of mind.

These conversations were 100% voluntary on Scott's part. That goes a long, long way.

I haven't read through the whole thread so don't know if this has been said yet. I was just listening to the radio news and they said that Gagarouse will probably be cross-examining Amber as early as this afternoon.

Of all people, YOU have just got to read the part where Scott tells Amber he "saw her in the mirror". I think it's in the 2nd Jan. 12 tape, about pg. 30.

And also, do you notice how he keeps asking Amber to talk about her "suffering"? He also asks her, "This is affecting Ayianna, isn't it?" He wants her to describe how Ayianna is also "suffering" from this. She obliges, saying Ayianna is having trouble sleeping, etc.

I had a transitory thought when I kept reading his pleas to her to describe her and Ayianna's "suffering". I briefly thought that he enjoyed hearing about their suffering.

I dismissed it, but I see that someone on WS-- a poster named sirensong--had the same thought. So maybe I wasn't imagining things. Sirensong suggested that Scott gets off on other people's suffering and pain!

Regarding the mirror incident, he tells Amber what she was wearing, and she says, "As a matter of fact, I did stand in front of the mirror with those clothes that day." (Paraphrasing.) I think MizSterious called that one: he was trying to let Amber know that he was watching her, trying to freak her out to keep her under control.

I saw a TV show about a female profiler one time. Or maybe she was a true crime author. She talked to some serial killer at the prison where he was housed. That night, she was at her hotel room. She had let him have the phone number there. He called. He told her, "I'm looking at your window right now." She asked him how that could be. He said, "You know that phone booth off the parking lot?" He described the phone booth to a T. He said, "I'm right in it now, looking up at your window. I can see your shadow on the drapes."

She couldn't resist looking out the window. There was the phone booth--empty, of course. She told him, "You actually had me looking out the window." He laughed and enjoyed the moment--how he could get that deeply into her mind that he almost had her believing the impossible. Almost had her believing that he was so powerful, that he could be in prison for life, but then somehow be in a phone booth outside the hotel.

Quite the interesting exchange that proves that Peterson is a total lying sociopath.

The extent to which he played mental games gives me chills.

He says, he was worried that something had happened to Amber because he hadn't talked to her that night. Well, he'd already talked to her twice. He got so concerned that he called Sibley and asked her about Ambers well being.

It makes me think that he was trying to plant thoughts that Ambers life could be in danger from someone like a phantom abductor. When confronted directly by Amber he denied this.

I think he was sitting outside her house watching her (instead of finding Laci) to know what kind of clothes she just happened to be wearing. He played the information off as a psychic experience in his mirror. Again trying to plant mental thoughts that he might be psychic to try to cover his A@@ for the statement- this will be the first X-Mas without her.

I feel sorry for Amber... I feel even more sorry for Laci I can't imagine what mental torchers he put her through even before he murdered her.

To carry it further (okay, to carry it too far), I remember reading documents on TheSmokingGun.com about how Hitler (before he met with his great "success") used to greatly enjoy going to the circus and watching female tightrope walkers. People who knew him said he almost seemed to hope for an accident.

One time there was an accident. The girl fell and after suffering greatly, died. Hitler got so into it that he later sent flowers to her family.

He seems to have gotten a sexual thrill out of imagining--or seeing--horrible painful things happening to beautiful women.

Hey, that's a good idea! She had asked him if he was psychic or had E.S.P., that he was referring to having "lost" his wife, then after he said that, it really happened.

I think you've got something. Maybe he WAS trying to convince her that he was prescient, so that, in her California girl mind, that would explain away his reference to "loss" on Dec. 9.

I think in California they refer to all this stuff as "head games". He was definitely playing head games with her.

There is no way this jury would ever now think that this man was incapable of anything, no matter how creepy, macabre, or sick.

The fact it was not a custodial interrogation is irrelevant. The questions were coming from the police, not Frey. If this is allowed to stand, the police will just adopt the practice of coercing the friends and relatives of the suspect into asking the questions for them, totally obliterating the 4th and 5th Amendments.

The case you cited is completely opposite this one. The man had already commited a crime by commisioning a murder, espescially a judge. So they flipped the 'hitman' (or he was a police officer to begin with, as most 'hitmen' are officers posing as such). In the Peterson case, the police were searching for evidence, having no evidence prior that he had commited the crime, only suspicion. This is known as a fishing expedition, and has been consistantly thrown out on appeal. And this will be overturned on appeal if Peterson gets convicted. The police screwed the investigation up. They fixated on Peterson as the actual doer, and did not branch out into the more likely scenario in which he contracted a few scumbags to do the deed for him. Peterson lacks the testicular fortitude to do the deed himself.

There was some point where Amber's father hired someone to watch over Amber (he said, "to keep her safe") and I wonder if that occurred at about the time of the mirror conversation.

Remember the idea that maybe Scott was giving Laci some sort of poison to try and make her miscarry?

I can easily, easily imagine this man as the type who might give poison, after hearing all these conversations.

Didn't know that but, at one point LE found him in Amber's neighborhood. I have forgotten what day that was or the conversation they had.

Not surprising. He has lost control in his "real world". This is the only place he can feed his strong appetite for power, control and admiration. One reason some folks enjoy the suffering of others is because it makes them feel powerful and important.

So if Laci already knew about the cheating, and wasn't reacting to it, then how come Scott had to tell very specific lies to Amber in order to have the period from late December, till Jan. 25, free, w/o seeing Amber?

Great point !!! says it all....if he had permission he would have run thru the town like a junkyard dog in heat knowing Snott...another point, in all interviews Snott says he doesnt want to take the attention off Amber while his real life shows he could have cared less about her and never looked for her (hopefully the jury will consider the fact the ONLY one who would not look is the killer).
