Almost 4,000 gay couples, including Rosie O'Donnell and her lesbian partner, learned yesterday that their marriages are null and void. The California Supreme Court ruled unanimously that the controversial mayor of San Francisco, Gavin Newsom, overstepped his authority by issuing marriage licenses to same-sex couples.
The justices also ruled, 5-2, to nullify the same-sex weddings performed between Feb. 12 and March 11. Those weddings ignited a fierce nationwide debate and prompted President Bush to push for a constitutional amendment to ban same-sex marriages.
"The struggle for civil rights continues in America, as usual," O'Donnell told the Daily News through a spokeswoman yesterday, adamantly adding: "Vote for John Kerry."
The court's rulings yesterday, however, only addressed whether a mayor had the legal authority to go beyond state law. Broader arguments about the legality of gay marriage are expected to be heard before a lower California court next month.
Anti-gay-marriage groups hailed yesterday's court rulings.
"Instead of helping his cause ... Newsom has set back the same-sex marriage agenda and laid the foundation for the pro-marriage movement to once and for all win this battle to preserve traditional marriage," said Mathew Staver of Campaign for California Families.

They be cryin in the wine. hahahaha
Well, they couldn't consummate the marriage anyway, not without a genuine Mr. Johnson.
I wasn't aware Ms Kmart was such a strong advocate of civil rights. Perhaps she'd want to join the oldest civil rights organization in the nation.
Ya know, I just don't think the rank and file of the NRA would welcome her.
The BIG story here is the 2 judges who voted against nullification!
Someone should mention to Kerry that Rosie thinks he's going to change things when he's the new sheriff. Bet it would get an entertaining reaction.
I saw Mayor Newsom comment on the California Supreme Court ruling yesterday. I don't recall all he said, but he did say no damage done in reference to his decision to issue marriage licenses, not the ruling.
It would tickle me if those 4,000 homosexual couples would turn on the mayor and San Francisco with a class action lawsuit. That would almost constitute a divorce among the homosexual community and San Francisco! I'd be laughing my butt off.
If San Francisco issued the licenses without a waiver of liability should the licenses be invalidated, as they were, a lawsuit is justified.
Your thought matches mine.
Clearly, these people are now living in sin, and apparently, have been for months now, as they were never married. The confessionals are going to be filled now with homosexual penitants. The churches better add some additional hours to those schedules this week to accomodate these poor souls.
.
O'Donnell told the Daily News through a spokeswoman yesterday, adamantly adding: "Vote for John Kerry."
Really, Ms Abnormal, do you really think that an endorsement from someone with your character will get him many votes?
The NICE thing about Rosie being gay is she can't reproduce herself.
They all knew these "marriages" were not legal before they got them. Newsom also was also aware of it.
I don't know - robbing a sperm bank is a possibility...
She then added: "He says he against homosexual marriage, but of course he's lying. My buddy John lies about everything! So, when he says he doesn't want people like me to be married, I know how to break the code."
I wonder how many of these "couples" secretly breathed a sigh of relief yesterday. Maybe gay "marriage" isn't all it's cracked up to be.
LOL
The only was these things go to a church is to get close to children in order to attempt to corrupt them.
