I know it is hypothetical, but what is the law about substituting someone else for Kerry/Edwards now that he has accepted the nomination.
Can Kerry be substituted for on the ballot?
Why not figure it out now, rather than scramble around for the reasons it is illegal when they pull it on us.
The first reaction will be critical.

He could simply resign and Edwards would move up.

Doubtful. One state's Dem Party making a substitution is one thing. Pulling Kerry for The Hildabeast would require all 50 states' partys working together.

Hmm, sounds like something that should be suggested on Democratic Underground. Maybe it'll give them some ideas ;)

The constitution provides sufficient grounds for this:
Amendment XIV
Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.

I think the leaders of the liberal Dems (the Clintoni family) are real happy with the way Kerry is self-destructing. In my opinion, that is exactly what they want -- for that reason, and probably others, he will remain on the ticket.
Unless the Clintoni family loses control, they are right on their plan centerline. Hillary in 2008. (as absurd as the concept is).

This is called the "Lautenberg Gambit", and it worked in New Jersey... and heaven knows, the Dems seem to want to make up the rules as they go along.

Are you inferring that Sen. Kerry isn't an American war hero?

Well according to the NJ Supreme court, the people have a right to a viable Democrat candidate. I'm sure the courts would let the 'Rats violate whatever ballot deadline they would have to to replace John F'n, if it became necessary.

Why would they (Democrats) do this?

Yes, he could be pulled, but it would have to be before the deadline for getting a new name on the ballot.
P.S. It won't happen.

This is called the "Lautenberg Gambit", I am looking for the Presidential election law, is it a state by state ballot issue? I am sure that Hillary and McAuliffe have this all figured out. I am serious about this request, I don't think it is likely, I just want to know whether it is even possible.

From Teresa's reactions to him I would say not.
She always looks like she is avoiding a kiss from her brother when he tries to kiss her.

Replacing Kerry on the ticket may not be as difficult as replacing his name on the ballot.
Every state establishes it's own deadline for ballots to be finalized, if Kerry withdraws from the ticket after any of these deadlines, his name will likely remain on the ballot in those states.

Why would they (Democrats) do this?If there candidate for whatever was so damaged as to have no chance of election, they would do it if possible, IMHO. It hasn't happened yet, but it could. It happened in NJ for that same reason.

Yes, he could be pulled, but it would have to be before the deadline for getting a new name on the ballot.Does anyone know what that date is? It is at least after the GOP convention?
