Impeach Judge Hamilton

It must stop. On Tuesday, U.S. District Judge Phyllis Hamilton of California declared unconstitutional the Partial-Birth Abortion Ban Act passed overwhelmingly by Congress and signed scant months ago by the president, while being supported by 75 percent of the public. As a consequence of Judge Hamilton's injunction, the appalling partial-birth abortion procedure will continue to be practiced across the land. Because of her order, living infants will continue to be killed in a most cruel manner. It abrogates the clear will of the majority of American people on the matter, as expressed both in public-opinion polls and the votes of their elected representatives.

just when the dems thought they had dodged a bullet :having to actually take a stand (on this heinous procedure) before the elections, the circus court brings it back front and center and makes it an issue again....

Now which politicians do you think most wish this had stayed buried for about another five months?

Since our troops are sworn to uphold and defend the constitution ,
Special forces should rightly pull the 9th circuit court from the bench kicking and screaming and take them to GITMO and throw away the key.
Judges fabricating rights where none exsist, and ignoring the rights of the only truly innocent, the unborn.

MILLIONS of inocent victims slaughtered every year in the name of convenience. Not to mention partial birth atrocities.
I am ashamed to be an American today.

Sadaams got nuthin' on US...........
And we just lay down and take it.

Since our troops are sworn to uphold and defend the constitution ,
Special forces should rightly pull the 9th circuit court from the bench kicking and screaming and take them to GITMO and throw away the key.

Laura Ingraham had a great show on this today. She found an article about a NY Clinton judge that ripped into lawyers. I wish I knew where she got it. He wanted to know every detail. Anyone have a link let me know.

Impeaching Hamilton won't undo her rulings. And politically, well, you have a better chance of electing Micky Mouse as president--it ain't gonna happen.

A better and more effective way to kick butt is to use another power the Constitution recognizes explicitly in Congress. Article III sec. 2 says that Congress, through a simple majority vote, has the power to define and limit federal courts' jurisdicition.

All Congress needs to do is pass the same law, with a rider that says the law is outside of the jurisdiction of the courts to review. That's fully constitutional--and will put a chill not just on Hamilton but on hundreds of activist judges all over the country.

Congress was designed by the Founders to ultimately be the supreme governing body--not some dilusional ridiculous robed judges.

The main reason that the Left is so fond of legislating from the bench is the essential elitism involved. Rather than having an important issue hashed out on the floor of a legislative body, we have a Philosopher King sparing us all the bother.

I hope this is alive and well when November finally gets here, Bush can make a few more speeches about justices legislating from the bench, maybe it will be worth a few senate seats.

This is absolutely disgusting. Be careful, guys, and don't fool yourselves. The Republic hangs by a thread when a single, autocratic person (a judge at that) can overturn the Constitutional right of the Legislature and the President to pass laws that benefit the people of the U.S.

Judge Hamilton's power madness is an abomination, and the slaughter of the innocents continues.

I'll pop a cold beer and roast Marshmallows the day Judge Hamilton dies.

How and when will this ever come to pass ?
We cant even get the republican half of congress to stand up and fight for the Judicial nominees.
Somebody stop me but I am a hopelessly cynical curmudgeon with an Eeyore the donkey point of view today.

I fear the congressional appeasers and "wanabee moderates" will just buckle under when it comes to more judicial nominees in the future.

What happened to the US goverment I was taught about in High School ?
It seems like it morphed into some kind of atocratic P.C. homeowners association board meeting ..............

Hear hear! While the Liberal Media busies themselves filing FOIA requests to obtain every Abu Gharib photo, video, and piece of underclothing they can, in the name of crying out about the abuses suffered by Iraqi prisoners, this so called "judge" is held up as a defender of freedom!

Imagine the outcry if a video emerged from Abu Gharib, showing an Iraqi having his head crushed in a metal press until it exploded and his brains were spread out?

Imagine the feigned "We debated about showing you these graphic video images, but it is our {little golden halo appears over head}Journalistic Responsibility {halo goes away} to show you...{devil horns appear}THIS!{devil horns remain, where they belonged anyway}" if there was a video of an Iraqi prisoner, head rammed through the bars of a prison door, back to the camera, while a 'surgeon' hammered a stake through the prisoner's spine? And then another forces a hollow steel shaft into the base of the skull, only to turn on a vacuum and liposuction the brains out of the prisoner?

Well, that's what the "judge" is upholding as democracy, as justice, as a woman's right. Well, isn't Lindsay England a woman? Why then is she in so much trouble over the goings on at Abu Gharib? Maybe the "judge" needs to take up military law, too.

It's always hard to be a Californian, but this has been a wretched week. The LA County seal and now this judge. All I seem to do is email and telephone govvernment officials who basically laugh at your indignation. It's like living in a foreign outpost!

A top-down solution alone will not work. We must change minds and hearts.

I am suggesting all pro-lifers do this on every DAY AFTER a law protecting innocent life gets struck down to remind people of what is legal in the United States of America...
