Sleep apnea can cause daytime somnolence. You don't get enough oxygen during the night (for a variety of reasons: Obesity, upper airway obstruction etc.). So you awaken multiple times during the night and you often get drowsy during the day. This has NOTHING to do with the fact that he's a traitorous murderer. It won't work for some sort of half-assed insanity defense.

After 22 years in the military (2 Navy/20 Army), being a military court reporter for 16 of those years, and a DoD civilian court reporter since 1995, I am very seriously of the opinion that I would much rather be tried in a military court than a civilian one.

Those on this thread are exactly right in most every respect. A potential capital murder case can take many months to investigate and prepare for; additionally, the defense counsel are going to everything that they can to ensure that the accused is adequately represented. The prosecutors will also want to take all of the time that they can get from the military judge to make sure that they have every "I" dotted and every "T" crossed. A conviction alone is going to result in massive appeals; life in prison without parole or a capital murder sentence is going to result in even more. Let's have patience here ... the job will be done right.

I have seen guilty plea cases that took only a matter of days from referral of the Charges to the court proceedings and sentencing. The quickest one that I was ever involved with was 15 days from the date of the commission of the offense to the day of trial (and sentencing).

All that being said, I just hope that I don't get detailed to this case ... it would be very hard to remain neutral and detached.

Yeah, you're right. I hadn't read far enough into the story when I made my comment. So by all means, let's bash away at them!

Interesting comments. I don't have any experience in a military courtroom (other than TV show I watch only rarely) so it's good to have your perspective.

This case just cries out for the death penalty for whoever is guilty. I hope that's the end result. It's probably a good sign that the case is moving slowly -- I hope that means they're moving carefully.

It won't happen if the military gives up jurisdiction it is over, the government will prevail, this scum will stand before Courtmarshal.

Why wasn't this guy lined up and shot by his officer....you can be damned certain that if I was the Captain of his company he wouldn't be on trial right now.
