VIRGINIA SENATE OVERWHELMINGLY PASSES BILL CLOSING LOOPHOLES ON ILLEGAL ALIEN BENEFITS

STEIN REPORT XXXXX Tuesday, February 17 2004 16:00:26 ET XXXXX

VIRGINIA SENATE OVERWHELMINGLY PASSES BILL CLOSING LOOPHOLES ON ILLEGAL ALIEN BENEFITS

In a lopsided, veto-proof vote, the Virginia Senate passed SB521, a bill that requires most people claiming Virginia residence to prove that they are lawfully in the U.S. This comes on the heels of a major victory last year to deny a Virginia drivers license to illegal aliens. Activist groups across the state, who have been pushing measure like this since 9/11, expressed their gratitude for the expertise and advice offered by FAIR during this important fight. "Our Coalition is extremely grateful for the enormous contribution that Fair has made in getting SB 521 through the first phase of legislative process," noted Bob Shoemaker. SB 521 is a model, state-based initiative to prevent illegal alien misuse of government services and outlaws the acceptance of the controversial consular matricula cards while safeguarding the rights of legal immigrants and citizens.

Virginia, good news bad news. This is the good news this bill.
But the other bill allows gays to buy health insurance and put their "partner" on the policy the way that a spouse would for his/her family.

Someone brought up a good point about gays and hiv and what it means to everyone elses premiums since catastrophic health causes everyones monthly bill to be raised.

Whats up with Virginia?

At least Virginia has their head screwed on right. States like NY, Maine, and Washington are rolling out the red carpets for illegals. They just can't get enough of the lawbreakers.

black-robed tyrants

I like the way you worded that.

Hopefully, those who wrote the bill, thought of that possibility.

This is still not foolproof. It does authorize accepting identification issued by another state. Thus, if an illegal goes to say, New Jersey, and get a driver's license, that illegal can move to Virginia, and produce that document as verifiable identification issued by another state. Seems like a big fat loop-hole to me.

By the way, this has only passed the Senate, and as of this evening, it was communicated to the house, but not yet voted. Senate is more liberal, and the vote was 33-7. (Probably because of the loophole.

Here is the bill as introduced:

CHAPTER 55.2.
SECURE AND VERIFIABLE IDENTIFICATION.
§ 2.2-5512. Personal identification requirements.

For the disbursement of those public services, including law-enforcement services, in the Commonwealth that require recipients to produce personal identification, no department, agency, commission, or other public entity in the Commonwealth, or a political subdivision thereof, shall accept or recognize any identification document unless such document was issued by a state or federal authority, and is verifiable by federal law enforcement, intelligence, or homeland security agencies. No public entity in the Commonwealth may authorize acceptance of other than such verifiable identification, nor may any public official acting in his official capacity accept, acknowledge, or recognize other than such verifiable identification, nor may any public entity in the Commonwealth or political subdivision of the Commonwealth rely on or utilize in any manner other than such verifiable identification for the purpose of issuing to any person any form of identification, license, permit, or official document.

§ 2.2-5513. Exceptions.

Exceptions to § 2.2-5512 shall be made only as mandated by federal law, and for the purpose of reporting a crime. Actions knowingly taken that are inconsistent with the provisions of § 2.2-5512 shall be deemed outside the official capacity of the agency, officer, elected official, agent, or employee so acting, and shall not be protected by governmental immunity.

If we could get some of that same attitude here in Washington State Legislature I'd be thrilled.

I hear that Arizona, Colorado, and Kansas are working on eliminating benefits to illegals.

Also, good work to FAIR

FAIR is on the front lines in the battle against illegal immigration. I've seen Dan Stein on cable news many times and he is very knowledgeable and a great debater on this subject.

Sorry to inform you, but California beat Virgina to rid themselves of illegal aliens way back in 1992 with CA Prop 187. As usual, California was light years ahead of the other states.

After we won our free election *overwhelmingly*, the Federal government in concert with the state government burned our ballots and declared our free election illegal.

Look for the feds to come in and declare your election illegal, or otherwise do an end run around the people of Virgina.

Oh, and we don't need anymore out-of-stater thanks. We have enough here already, like Boxer, and Gray Davis, both from NY.

Conservatives in California are planning on reviving Prop 187, or was it 87? Anyhow, it may be the beginning of a conservative revolution, state by state. That's the only help we'll get on the issue of illegal immigration - state by state. Perish the thought that the Dems win, as they will immediately give 12 million of them citizenship and the state laws won't mean a thing.

That really is a fantastic point. If the general public were made aware of the potential impact on their own health insurance premiums that this would have, I wonder what the response would be? I'm sure we'd hear the tired argument that AIDS/hiv is a hetero disease too in spite of statistics showing that the vast majority of those infected are engaging in high risk behavior. Appealing to people's pocketbooks is never a bad idea.
