Boy's blow costs family $15,000 (Kid kicks waiter in cajones; waiter sues)

A 9-year-old boy's kick to a waiter's crotch cost his parents $15,000.

The waiter, then 26, filed a lawsuit against the boy and his parents, claiming the kick caused him great pain and that sex will never be the same, according to the suit.

The waiter, who asked not to be named to spare him further embarrassment, was at the boy's upscale Buckhead home April 10, 1999, setting up for a wedding reception. He claims the homeowners left their two boys unattended to dash off to the wedding.

The boy and his younger brother were running around wildly and the oldest child threatened the waiter and other catering staff from Agnes & Muriel's, a popular Midtown eatery, with a knife, the suit alleges.

The waiter claimed he stepped in and asked the boy to put the knife down and go outside to the back yard. The boy headed that way but then turned and delivered a swift kick to the waiter's left testicle.

The waiter said he developed acute epididymitis and erectile dysfunction, court records show. He missed work and mounted medical bills that topped $4,400.

The boy's parents claimed either they or their sitter were watching their children at all times and their sons were "playing in normal manner for young boys," court records show.

They insisted the boy didn't kick the waiter or threaten anyone with a knife.

A Fulton County jury delivered its blow to the little kicker this week.

IF the law would allow, which it won't, a better penalty would be a flogging for this idiot, and the parents who gave spawn to him.

Things like this make me look back at how I raised my kids (20 plus years ago) to be respectful, and just shake my head.

That said, this is one of those articles that you can't help but chuckle at when reading it.

That judgement is too small by at least an order of magnitude.

The little demon should have a similar injury inflicted upon him, just to make sure he doesn't breed.

What a brat! If the waiter suffered a medical injury, he has every right to sue. And what parents would bring children to an upscale restaurant like that, anyway?

One remembers the story of the lawyer who fought with a farmer over the ownership of a shot duck that landed on the farmer's land.

The farmer sez: "Out here we settle things the old fashioned way: we kick each other in the crotch. First one to give in loses. Since the duck landed on my land, I claim first chance."

The lawyer agreed. The farmer wound up and gave him a mighty kick in the cojones.

The lawyer gasped, doubled over in pain for five minutes. Finally he struggled to his feet. "Okay. My turn."

"The duck's yours," the farmer said, and walked away.

The epididymis is a structure of tubules that transport sperm from the testicle. It is palpable on physical examination on the posterior or rear of the testicle. The tubules within the epididymis merge to form the vas deferens. The vas deferens is the tube that is cut during a vasectomy to prevent sperm from mixing with the remainder of ejaculatory fluid.

Epididymitis is an inflammation or infection of the epididymis. This can occur as the result of trauma or infection. Frequently, the cause is not determined. Symptoms of epididymitis include discomfort in the region of the testicle. This pain and tenderness is often referred into the groin and occasionally into the abdomen. Swelling and firmness in these tissues can also be a component of epididymitis. As with any change in testicular exam or sensation, this should be examined by a physician. Treatments of epididymitis include antibiotic therapy, anti-inflammatories, and scrotal support. Cold therapy can be used for acute epididymitis. In cases where the epididymitis has progressed to a firmness or induration of the tubules, treatment usually produces relief of the pain prior to complete resolution of firmness of the inflamed tissues. Diabetics and other individuals with underlying systemic illnesses are more susceptible to this type of infection.
