Maybe I'm missing something, but when the State Supreme Court of Mass. orders the Legislature to pass a law, are they not in direct violation of this article of the state Constitution? And as such, can that not be appealed to a) them, and b) the U.S. Supreme Court?
Also, cannot other states deny acceptance of the recognition of these "marriages" due to the fact that it was done extraconstitutionally?
I'm not a lawyer, I don't play one on TV, I'm just a concerned person. I live in North Carolina, and so why would I have a dog in this hunt? Because if the idiots in the Supreme Court in Mass. can get their agenda through, then we are affected here in NC.

Our country is going absolutely insane. This song, I believe is about the pain of someone contemplating or attempting suicide. Unfortunately, with the decisions like the one from Mass. it's not too far away.

This is why IT IS SO IMPORTANT to have a President who supports and appoints conservative judges..WHO DON'T LEGISLATE FROM THE BENCH..........when stuff like this happens, average "joe" citizens, like you and I have NO vote in what will effectively "weaken" an institution
It IS all about the judges!!!! Presidents, senators and representatives come and go......but MANY IMPORTANT JUDICIAL APPOINTMENTS ARE FOR LIFE!!!!!

The State of TASSACHUSETTS has long ago gone and become a "government of men" rather than of laws.
The fact they have passed this law is self evident
When the highest court starts violating the constitution, state or federal, a serious problem is presented. Obviously, there isn't a LEGAL solution to this problem. There is a POLITICAL solution. Hang on long enough, and elect enough people who will appoint judges (Justices) who will obey the law, and the problem is solved. But that takes time.
There are two alternatives I see in Massachusetts that are quicker than waiting for the ratification of a constitutional amendment which will be proposed, shortly. One is to provide for retention elections for Massachusetts judges -- the same process in California led to the removal of FORMER Chief Justice Rose Bird and others in California.
The other solution is truly creative. The Court has said that the Massachusetts legislature MUST give the exact same rights to homosexuals as to heterosexuals. Take that as a given. The Massachusetts legislature has the option to abolish marriage for anyone in the state, until the citizens have a chance to vote on the amendment to solve the problem.
Everyone who wanted to get married in Massachusetts would have to go across the line into Rhode Island, Connecticut, wherever, to get married, until the problem was solved within the state. There would be an absolute firestorm of protest, of course, but it would be rightfully directed at the SJC, and they would well deserve it.
