Dumb Question (VANITY)

Article XXX. In the government of this commonwealth, the legislative department shall never exercise the executive and judicial powers, or either of them: the executive shall never exercise the legislative and judicial powers, or either of them: the judicial shall never exercise the legislative and executive powers, or either of them: to the end it may be a government of laws and not of men.

Maybe I'm missing something, but when the State Supreme Court of Mass. orders the Legislature to pass a law, are they not in direct violation of this article of the state Constitution? And as such, can that not be appealed to a) them, and b) the U.S. Supreme Court?

Also, cannot other states deny acceptance of the recognition of these "marriages" due to the fact that it was done extraconstitutionally?

I'm not a lawyer, I don't play one on TV, I'm just a concerned person. I live in North Carolina, and so why would I have a dog in this hunt? Because if the idiots in the Supreme Court in Mass. can get their agenda through, then we are affected here in NC.

Can somebody please explain it to me?

I'm listening right now to a song by an early 90's band called Saigon Kick, and the song is Come Take Me Now. Some of the lyrics are appropriate.

Our country is going absolutely insane. This song, I believe is about the pain of someone contemplating or attempting suicide. Unfortunately, with the decisions like the one from Mass. it's not too far away.

The Torch in NJ was low in the polls- dropped out and the Louse was allowed to run in his place in violation of the state constitution-with favorable ruling of their supremes. So, the answer is that if it favors the commies, then the laws can be suspended. SO-- "You sit down! You had your say!"--

This is why IT IS SO IMPORTANT to have a President who supports and appoints conservative judges..WHO DON'T LEGISLATE FROM THE BENCH..........when stuff like this happens, average "joe" citizens, like you and I have NO vote in what will effectively "weaken" an institution

It IS all about the judges!!!! Presidents, senators and representatives come and go......but MANY IMPORTANT JUDICIAL APPOINTMENTS ARE FOR LIFE!!!!!

The State of TASSACHUSETTS has long ago gone and become a "government of men" rather than of laws.

The fact they have passed this law is self evident

I hate this, BUT if you were from a state where the age for a driver's license was 15 and you got one. You move to a state where the legal age is 17, your driver's license, although valid to drive in your original state and is valid to drive THROUGH the state where the legal age is 17, would not be valid upon taking residence.
That is because "the state" considers civic marriage, driving, fishing, etc. privileges.

You are EXACTLY right. The Supreme Judicial Court of Massachusetts is violating the "separation of powers" requirements that are even more explicit in the Massachusetts Constitution than in the US Constitution. The problem is, how to bell the cat?

When the highest court starts violating the constitution, state or federal, a serious problem is presented. Obviously, there isn't a LEGAL solution to this problem. There is a POLITICAL solution. Hang on long enough, and elect enough people who will appoint judges (Justices) who will obey the law, and the problem is solved. But that takes time.

There are two alternatives I see in Massachusetts that are quicker than waiting for the ratification of a constitutional amendment which will be proposed, shortly. One is to provide for retention elections for Massachusetts judges -- the same process in California led to the removal of FORMER Chief Justice Rose Bird and others in California.

The other solution is truly creative. The Court has said that the Massachusetts legislature MUST give the exact same rights to homosexuals as to heterosexuals. Take that as a given. The Massachusetts legislature has the option to abolish marriage for anyone in the state, until the citizens have a chance to vote on the amendment to solve the problem.

Everyone who wanted to get married in Massachusetts would have to go across the line into Rhode Island, Connecticut, wherever, to get married, until the problem was solved within the state. There would be an absolute firestorm of protest, of course, but it would be rightfully directed at the SJC, and they would well deserve it.
