THE PERSECUTION OF RUSH GOES ON MARK A SITY 12/26/03

Years ago, Brett Favre had a problem with pain killers. He was buying them illegally after a prescription ran out for after an injury that still hurt. He became addicted. After the news came out, he apologized to his fans, went into treatment, and all was right with the world. Not a soul seems to be interested in investigating Ozzy Osbourne’s drug use, but there might be a reason for this. Ozzy seems to be attempting to prove the theory of evolution by devolving into lower forms of life before our eyes. Ozzie is an interesting scientific experiment.

Yet, Rush Limbaugh is reported to have a problem with an addiction to pain killers, admits it and goes into treatment, and all is still not right with the world. Rumors are reported first that he’s part of a drug ring investigation. Ok, it seems this is true in that his name turned up as a customer. Then rumors were reported that he was buying these prescription pain killers in 1000+ lots. Then rumors were reported that he was involved in selling the drugs (like he really needs the money!). Then it was money laundering. Now he is under investigation for the very serious crime of “DOCTOR SHOPPING”. It seems this is a huge crime in Florida.

This makes me wonder. If I take my family to Florida for a vacation, and our daughter hurts herself, let’s say she hurts her leg. Being from Wisconsin we wouldn’t know who the good FL doctors are and who the quacks are. We’d probably take her to the closest doctor. So let’s say we get Dr Quack. Dr Quack takes her into the X-ray room, and comes out with an X ray showing a hairline fracture in her calf bone. We would assume a leg cast is in order. Dr Quack comes back with not the plaster cart, but a laughing gas cart and then pulls out a big meat saw. Dr Quack tells us he will have to amputate her leg for the hairline fracture. If we decide to take her out of the office (with both legs attached) and look for a second opinion are we in violation of FL law for “DOCTOR SHOPPING”?

I don’t claim to have any inside information on Rush’s situation, but drawing on what he has said, it seems that he had a painful back problem and went to Dr Quack. Dr Quack recommended surgery. Dr Quack messed up the surgery. Dr Quack prescribed a pain killer to Rush for temporary relief of a long term problem. Dr Quack’s prescription ran out on Rush, leaving him in debilitating pain. Rush knew the pain killer could allow him mobility, and Dr Quack offered no option other than permanent debilitating pain for the rest of his natural life. It seems to me that Rush should have been “doctor shopping” a long time ago!

Why is Rush on trial here, without even any charges being filed? Shouldn’t Dr Quack be the one being investigated for leading an innocent victim down the path of lawlessness and drug use? Where is the AMA? Could it be that they, along with the press have an anti-Rush agenda? Nah, couldn’t be. If I believed that I’d be one of the black helicopter conspiracy types then, wouldn’t I?

Eliot Spitzer has ruined a local mutual fund company here in the Milwaukee area be insinuating through the press he has some evidence of wrongdoing on the part of it's CEO. Problem is, this has gone on for months and he has yet to issue any charges. In the meantime, billions of dollars have been pulled from the fund and the company's survival will most likely be dependent on being purchased by another fund. Does Elliot Spitzer care that the 1500+ employees in Menonmonee Falls, Wisconsin will likely lose their jobs? I'm sure all he cares about is making headlines and furthering his political career.

The prosecutors in PBC are playing the same game. We'll see who wins and who loses.

Please spare me the ad-hominem attacks. Rush is a hypocrit, he has been exposed. He is a drug abuser and that is prooven. I wish him the best in his recovery. But he can no longer espouse his all virtuous moral authority upon me any longer. He is an apologist and will not take ownership of his failure. When I was a Marine when I screwed up I ADMITTED MY FAILURE AND TOOK OWNERSHIP! That is a man! This gentlemen cowers behind the microphone and blames everyone else for his failure on this. This is not a man! So before you jump up to label me know whom you are speaking to. As per my hypocricy save it friend I am a man of my word!

Rush has to take responsibility for his actions, and the prosecutors and other Rush enemies have to do the same.

The problem is that there is no proof (yet) of him doing anything illegal, and certainly not to the extent that the prosecution is going after him vs. other high-viz people found in the same situation.

Xlintoon was held to a higher standard, and he was absolutely proven to have committed perjury. Unfortunately, the "jury" in the senate ignored the obvious and voted on party lines and he was acquitted.

XXX42 did get hit with a couple of minor penalties for obstruction of justice and "giving false testimony", and had a fine a his law license revoked for 5 years.

I mean addicts who commit crimes either to fund they're addictions or because when they are under the influence of drugs.

Funding is a problem, in part, because of the premiums associated with a blackmarket, no? Are you more troubled by crimes committed by those under the influence than by crimes committed absent drugs?

Do you favor the outlawing of other supposed/presumed reasons for destructiveness? Violence in movies or video games, for example?

I've read many, many reports where murder, arson, accidents, and other destructives actions have been committed to collect insurance payments. Must we outlaw insurance? Should the entire class be kept in from recess because one threw a spitball?

This does not stray from the fact that he is a drug abuser and the only way to become a drug abuser is to do it illegally.

Because he does the SAME THING everyday on his own show! Finds faults in others, exposes them then cries sour milk and runs to his audience to beg for forgiveness.

And he did this to himself. There is NOONE to blame but RUSH himself for this one. When you make a daily point of poiting out the political flaws and use comedy to laugh on people you do not agree with what is Rush to expect? A warm and fuzzy? Cmon...

I have my own mind. This is why I have not become one of the lock-step sheeple that follow this man and tow the same old party line. this is why there are ardent Rush defenders that disagree with me here. I respect your opinion but to defend this man who has went against EVERYTHING he stands for then to blame everyone but himself, that is cowardice and are actions of a child.

So your expectation of Rush is for him to cooperate, regardless of the motives of the prosecution and their incompetence, right?

Right. Catching them on the procedural error was fine, but he wants to keep the records blocked no matter what.

He should just give up any defense at all because he said he would cooperate.

Didn't he say he was going to take responsibility? If the medical records show the doctors knew about the other prescriptions, then he's cleared, so it's in his best interest if he's innocent for the prosecutors to see them. If he's guilty, he should take responsibility for his actions and plea bargain. But no, he's whining like Clinton during Whitewater.

No - it has not been, otherwise the records would have been ordered returned.

In FACT, from the hearing on Monday this is the second Judge to rule on the legallity of the search warrents.
By resealing the records he is simply allowing time for another appeal.

This has been my whole contention. This man is whining like the same people he harps about on the radio. It is one thing to come out and admit fault and take ownership for your own actions. It is another to whine about everyone else to deflect fault from yourself. Then to top it off still get on the radio whine some more then give his listeners a lesson about the personal/political faults of others.

I think he has taken responsibility. He said he was addicted. He acknowledged he was wrong, and he went to rehab.

Maybe he doesn't want liberals to pore through his medical records. Do you think there might be some other things unrelated to his drug use in there? Maybe he has other medical issues that would be embarassing to anybody let alone the famous. Do you think they will differentiate between the two when they leak the entire contents? Did you just fall off the turnip truck?

The search warrant were legal, but there is a question as to the application of a search warrant in this case. Proper procedure for medical records is subpoena. The prosecution didn't use that because issuance of a subpoena requires a hearing at which time the defense can state their objections and the judge can rule on them.

Do you beleive in the protections that are built into the system or not? If prosecutors can just make the stuff up, look out.

I think he has taken responsibility.

On the personal side, but not on the legal side of the War on Drugs he supports. Maybe he is just afraid of being exposed as a hypocrite?

The prosecutors leaking information can be handled in other ways, such as a fat civil lawsuit.
