The court doesn't know how to read the law. They'll be corrected: Padilla is being held, under the law, as an ENEMY COMBATANT...not unlike those jokesters in Guantanamo. He's got the unique designation of being a citizen who trained and planned with Al Qaeda. That was my understanding of the Padilla case

My conservative leanings are documented on this board and in my life--your opinion of me means less to me than I can express. I can let you know this: I'll be supporting the War on Terror instead of defending Al Qaeda Terrorist who happen to live in Chicago. You can pick whatever side you want, thought it appears you already have.
The Constitution refers to the pursuit of life, liberty and the pursuit of happiness, doesn't it? Your desire to die on a hill for Padilla would result in fewer Americans having that right--because they'd be busy dying from the Radiation Bombs Padilla and his ilk set off.

Neither. Apparently missed the news reports that detailed Jose Padilla's sorry life as a criminal, and his movements in the four years prior to his arrest. The reports even had his passport, travel arrangements, and other evidence. Maybe you should call EMS and have them break out "the jaws of life," so they can help you pull your head out of your ass.

and there are plenty more Padillas out there, with US citizenship. If this stands, Muslim countries will start loading their 9 month pregnant women onto planes so they can land at JFK airport and have their babies while at the US immigration offices, so their new soldiers in the fight against America can have US citizenship and the protection of our court system.

I'm willing to give them a lot of slack/benefit of the doubt regarding the War on Terror.
Here's the problem with that: The WoT is permanent. There are no even theoretical conditions that it could be declared over and 'war powers' rescinded. Even the president has said he expects it to last at least decades. By that time most living people will remember nothing else, thus these 'war powers' are not temporary, they have become the 'new normal'. Given enough time eventually someone who would abuse these powers against legitimate American dissidents will take power.
Next problem, is the absolute power this 'war power' gives the executive. The government's definition of terrorism is so vague, it can and I predict it will be used against those the government doesn't like. Dissidents may be imprisoned and called terrorists or criminals by the executive. But without a trial how do we know the accused is what the government says they are? We don't. There are no charges filed, no evidence presented, no chance to defend oneself. Simply put, if they say you're guilty you are. That's absolute power. And absolute power corrupts absolutely.
