Do these judges realize they're handing the GOP a supermajority in the Senate next year with these absolutely atrocious decisiosn?!?
To: dead
This whole Padilla thing was handled idiotically, and unconstitutionally, from the start. This guy is an American citizen. John Ashcroft can not just arbitrarily revoke those rights of citizenship...JOHN ASHCROFT HAS REVOKED NOTHING. THE DEPARTMENT OF DEFENSE, UNDER DONALD RUMSFELD, HOLDS CUSTODY OF PADILLA!
And I'm betting the administration will find a workaround on this B.S. ruling.

Oh, so Padilla has to be released?
Drop him off in an al-Qaeda neighborhood with about $25,000 in cash and a signed thank-you note from Rummy.
They didn't say HOW to release him...

For the decision:
Rosemary S. Pooler,
appointed 06/03/98 by President William Clinton
Barrington D. Parker,
appointed 10/16/01 by President George W. Bush
Against the decision:
Richard C. Wesley,
appointed 6/11/03 by President George W. Bush
That's a poor reflection, if it is one.

"I agree with this. The guy may be scum, even a terrorist, but either charge him with something or release him."
Bullcorn! He spent time in an Al Qaeda training camp in Afghanistan. Jose Padilla is a trained terrorist!
To: Recovering_Democrat
He's got the unique designation of being a citizen who trained and planned with Al Qaeda. Please see post #83.

As a citizen, he has rights.
Does that seem silly to you?

only if Bush goes to a microphone right now and calls them on it. this issue can only help us if we run with it, if the administration backs off, the media will spin it to the sheeple as if Padilla was just an innocent man caught up in the "tyranny of John Ashcroft".
To: Recovering_Democrat
And I'm betting the administration will find a workaround on this B.S. ruling. You may be right. I haven't seen a single administration that didn't "work around" the constitution when it suited them.

You renounce your citizenship when you take up arms against soldiers from your own country. Nonsense. Where did you get that piece of legalese?

Exactly! At the very least Padilla is guilty of high treason!
To: Recovering_Democrat
Whatever. Why don't you point us all to the "enemy combatant" exception in the Constitution? Or do you only embrace judicial activism when you agree with it?

Huh??? Padilla was caught at a US airport, O'Hare I believe.Yeah, after vacationing with Abu Zubaydah in the Middle East.
To: Destructor
Wow. Do you work for Ashcroft? Or do you just believe everything the government tells you.

Exactly! At the very least Padilla is guilty of high treason! Precisely, and the constitution has provisions for that. If found guilty, he could be shot. I'm all for that.

Good points, I'll think them over. Though in any case I will not engage in the bashing of the administration trying to keep this country safe after 9/11. I'm willing to give them a lot of slack/benefit of the doubt regarding the War on Terror.

he can't be charged with anything, because then he will start asking for the government to produce other detained terrorists as witnesses, and we all know why that cannot happen. so unless this insane decision is overturned, or Bush decides to create some kind of constitutional crisis by ignoring it, he will be released.
