Precisely, and the constitution has provisions for that. If found guilty, he could be shot. I'm all for that.

he can't be charged with anything, because then he will start asking for the government to produce other detained terrorists as witnesses, and we all know why that cannot happen. so unless this insane decision is overturned, or Bush decides to create some kind of constitutional crisis by ignoring it, he will be released.
