The whole Diabetes Defense was bogus and was manufactured long after the accident when charges were filed

I know that, I knew that was a very weak lie when I first heard it.

This (my post #145): This supreme jerk knows how serious his condition is. If he did not eat all day then not only was he jeopardizing himself, he was putting the lives of others in jeopardy. And the result is, he's guilty. was my reply to freeper HapaxLegamenon post #73 (I think) where he/she posted something about beyond a reasonable doubt.

I thought that was probably the weakest defense he could use, when it's on record he had 3 or 4 prior speeding violations in South Dakota, and the latest one involved a fatality.

Either 1. he thought he was above the law, 2. the law enforcement in SD was too chickensh** to dish out a ticket or 3. he paid off the law enforcement to keep it "hush hush".

I do not like this idea that someone who was not in the trial can be happy because the vedict matches his own judgement, based on information that comes through the press. It seems that Janklow was convicted on this site without a trial. If your sister has diabetes, then you should know that low blood sugar reactions can come without warning. Most posters to this site think that is obsurb. It shows their ignorance, and their arogance that everything in heaven and earth can receive a definitive judgement here.

The contention is that people who KNOW their ability to drive safely can be compromised, without warning, shouldn't drive. Plus, regardless of knee-jerk postings and reactions here, Janklow's conviction came from a jury, not from Free Republic.

The man has a terrible driving record, admits himself that he speeds all the time. He's blown the same stop sign before at least once causing a near miss. This is not about being diabetic and driving a car. This is about the jury seeing through his lies and doing the right thing. He lied with the low blood sugar defence and the jusry didn't buy it. Good for them.

I think only some diabetics have a condition that renders them suddenly, and without warning, unable to drive safely. And yes, people who KNOW they can be rendered, suddenly and without warning, unable to drive safely, should not put themselves and others at risk.

Notice all those conditions ... "suddenly", "without warning", and "unable to drive safely." Are you asserting that all diabetics meet thos criteria?

Some good possible candidates, but one point about SD politics is the "west river" factor. People clearly connected to Sioux Falls--e.g. former Sioux Falls mayor Gary Hanson, Sioux Falls business woman Barb Everest etc. will not gain GOP votes much west of Highway 81 and certainly not west of the Missouri River. To the west river folk Sioux Falls is a suburb of Minneapolis and not representative of the rest of the state. The further west in the state the stronger the sense of distance from Sioux Falls.

It (sudden, unexpected lapse into inability to drive safely) can happen to anybody. Heart attacks, strokes, old-age "confused the gas with the brake," etc. happen. The law draws a line "somewhere" that prohibits a person, who knows they are at risk, from driving. Obviously, that line is not drawn in such a way that prohibits all insulin-takers from driving. But I bet some insulin-takers, those with a history of falling into diabetic shock, have enough sense to not drive.

The jury, who heard the entire case, found Janklow guilty. That is hardly a slap at all diabetics.

If you are referring to me, go right ahead. Happy would not be a word I would use in this matter. But for myself I am pleased that the jury saw through this lie and convicted Janklow. There are other aspects of the case that would/should prevent people from rejoicing. One being that the deceased is still dead and his love ones have to suffer the pain and lost. And then there is Mrs. Janklow, possibly some Janklow grandchildren.

One thing for sure diabetes was not on trial. A wreckless inconsiderate vehicle driving individual was.

This does NOT prove the system works, per se, only that it works when the target is a republican, of the majority race in this nation.

A paul wellstone would have skated too, even though a white guy, he WAS a democrat. Lieberman would have gone to the chair, as he is too "centrist" and conservative for most democrapts. Any LIBERAL DEM would get the once over, whereas a JC Watts would have been fried.

That said, the guilty in no case, are innocent.
This guy deserves what he gets.
