Governor Seeks New Trial Over Brain Damaged Woman's Wishes

TAMPA, Fla. (AP) - Gov. Jeb Bush fired a volley of legal shots Wednesday at the husband of a brain damaged woman who is at the center of a right to die case, saying there needs to be a jury trial on whether Terri Schiavo wanted to be kept alive artificially.
The governor also sought to remove Pinellas Circuit Court Judge W. Douglas Baird from hearing the constitutionality of the new law enacted to keep Terri Schiavo alive after her feeding tube was removed last month. In yet a third legal filing, the governor argues that Terri Schiavo's rights under the Florida Constitution are being protected, not violated.

Terri Schiavo went for six days without food and water after her husband Michael Schiavo removed her feeding tube. Florida lawmakers and Bush intervened, enacting a hastily drawn law that allowed the governor to order the feeding tube be reinserted.

Michael Schiavo has challenging the constitutionality of the governor's action. He contends his wife had said she did not want to be kept alive artificially before she suffered severe brain damage in 1990. Doctors have ruled she has been in a persistent vegetative state since, but her parents believe she is aware of her surroundings and could be rehabilitated.

Bush's attorney Ken Connor said a jury has to establish what Terri Schiavo's wishes were before a court can decide whether her private health care wishes were violated.

George Felos, Michael Schiavo's attorney, could not immediately be reached for comment.

Would guys mind pinging your ping lists to this article. I am wondering-it this the response to Baird? Is there an underlaynig theme here of exactly WHO has the power? Seems to me-the people via their representatives via the govenor, in refining a law, have DONE EXACTLY what the constitution requires.....a VOTE to change the law. Seems the judges are living in an ocean of egomania, based on extremely suspicious motive on the part of MS and his attorney, crying anti-constitutional rhetoric, ie Terri's privacy, when they are doing EXACTLY the opposite....trashing their state's constitution and the newly enacted law.

Any Judge who continues to ignore the massive and overwhelming evidence pointing to MS as a truly sociopathic creep, who has VIOLATED, beyond a SHADOW OF A DOUBT THE FLORIDA STATE's LAWS regarding guardianship, will forever have the suffering of Terri Schiavo upon their hands. Forever.

Baird must be a very shallow, afraid man. And Greer, appears to have very untrustworthy people surrounding him....if it is true that his eyesight is failing.

If his eyesight functions enough for him to read...he is FULLY RESPONSIBLE for allowing the torture and virtual rape of Terri's right to rehabilitation and at the bare minimum, A FEW GENTLE PLEASURES, and needs he needs to be investigated for denial of adhering to the Florida Constitution, for violations of the guardianship assignment and elimination of evidence and affidavits CRITICAL to the life of Terri Schiavo.

You know, we can take our HUGE RECALL JUDGE GREER SIGN and add a flip-section and INTERCHANGE NAMES OF JUDGES as they try their darndest to kill this innocent woman. We talked about that the other night.

I'd be okay with Judge Lenderman holding the Jury Trial. He's the guy who put a stop to the "suicide on stage" by Hell on Earth. He's the only Judge I would half trust. Or, if there's too much pretrial publicity here, HAVE IT IN JEB COUNTRY, TALLAHASSEE, and Terri wins too.

I am reminded of something that Paula Jones said about her fear during the court case with Clinton. She said that she felt much safer once she was in the public spotlight because if she went missing or turned up dead, everybody would know something was up. I think she was right. There's a time to keep a low profile and a time that being seen can provide more security.
