This thread serves as a place for posting all new general information and references, along with links following Terri's case, plus information on cable news and talk radio shows dealing with the issue, court cases and press releases. This is also the place to post contact information, prayers and general discussion.
If you have something that qualifies as BREAKING NEWS or FRONT PAGE NEWS, please post it on a separate thread in that category in order to give it maximum exposure and then post a link to the article/thread here so that it will be included in the next update of links. Also, if you post links to articles from original sources and there is also a thread on FR, please link to the FR thread. Many original links become corrupt over time and we want to be able to access the information at will.
There was a tremendous amount of information posted on the previous thread. For anyone who hasn't been following the daily threads, links to relevant posts and information from the previous thread are contained in the body of the present one. I have found that very helpful in trying to find something later. You people are doing a spectacular job of getting information out and also in helping to keep all of us updated here. What a great joint effort. This fight, to me, illustrates beautifully what Free Republic is about and what it means to be a FReeper. Way to go FRiends. Keep up the good work!

In my mind .. (and in fact, I'm in the process of explaining this to my kids .. which they're hating because it isn't cut and dried) ... the terminal horror can be someone who DOES have a living will with a "do not resuscitate" order .. and maybe in a coma .. and could recover. THAT whole scenario .. now illustrated by the case of the guy with stroke in Maryland, wherein the doctors are fighting to honor his living will and his wife is objecting, is a horrific thought.
I believe if Terri DID have a living will, she would have been dead years ago, and we'd never have known about this evil in her life.
I'm just praying, and I'm urging my kids, to understand that I DO NOT want to be starved to death and I want every chance to live.. even if the docs are pushing to pull the plug. We now have to be very precise, convey those wishes, and pray that those around us should such a time come, God forbid, truly can be our warriors and angels, but I have now decided that I most likely will not get a living will.

A daily thread was resorted too, to accomodate all those complaining FReepers who were "bored" by the troubling subject of Terri Schiavo's impending court ordered death, and wanted not to read about the matter, in numerous new threads and articles.
We are being shushed.
After all,only a "few" of us FReepers care about the "topic".That must be why the posts have always gone in the 1,000s for each new daily thread.

I say flame the trolls and out them as the idiots they are.
Or ban them from these threads.
Perhaps we need to post a warning, that the saving of the life of a disabled woman from a court ordered death sentence is a "special interest topic", and ignorant comments are not encouraged, particularly since we are close to our goal.
I dont know about you, but I have been following this "topic" since 1995, and Terri Schiavo is not an exercise in mental masturbation to me.
I attendend the vigils outside of the Hospice where the courts of Florida allowed her dispicable execution to proceed.Once before in spirit, this time in person,several times, at financial loss and personal risk.
I do not apologise for my lack of patience for the new poster who just got through starving his or her parent or grandparent to death by starvation and dehydration, and is gung-ho on advocating tortuous deaths to anyone who can not speak against their own murder in a court of law.
It is not about them.
It is about a woman I will never meet, who has my permission to continue to live.Just because she is alive, and has committed no crime worthy of a court ordered death sentence.
I am shocked that my lone and small actions on her behalf, along with 100s of thousands of people is what was needed to stop her murder.
I am appalled at the number of posters on this site who thirst for her death.
To them, I say,I did not spend eight years of my life in the service of this country for your ilk. None who are fighting and dying now in foreign lands are fighting for your values, and you best bow your heads and shamefully look away when those who actually pay the price for LIFE,LIBERTY, AND THE PURSUIT OF HAPPINESS pass by.
(to make sure you know cindydawg, this is not directed at you.I am so mad I could spit or drop nukes,and I thought you might enjoy hearing the depths of my ranting rage against the trolls)

Your posts re: LKL interview spurred me to try to find that tape from the other night. Makes sense to double check. Can't seem to find it! hope it didn't get taped over. That will teach me to put a higher priority on labeling, something one would expect I'd already know from my lab days . . . "always label, always!"
I did, otoh, find Larry King's interview of Lisa Beamer 2/--/02, in which he tells her to be a little selfish & to take care of herself. It has been my / our prayer that more hearts will be softened, more minds opened to SEE, to PERCEIVE the truth about Terri. I do pray that will happen with him as well. May those who have the ability or power to do good for Terri -- do it.

But Terri didn't have a living will either, and look what her gem of a husband is energetically wishing on her based on alleged recollections which didn't come to him or his family until AFTER the malpractice award.
DO get the living will (or advanced health care directive), and in it make no bones about the fact that you object in the strongest possible terms to the "starvation therapy." These wills are not just used to will your death. They can also be used to will your life (God permitting).

Me too. Lawyers and courts get all caught up in procedures and petty questions and forget all about justice. Then they call it due process so that the constitutional guarantees of life and liberty (Fifth Amendment) are satisfied. The victim is deprived of life, but that's OK, she had her day in court and the lawyers made lots and lots of money.

This has dragged on YEARS too long. I'd love to see Terri home for the holidays, maybe with a kitty purring in her lap. I do hope Terri can finally receive the TLC she's deserved all these years.

As far as the money goes there is still that Promisorry Note that Terri owes to Michael. We still do not know the amount of the Note. We only know that of the $XXX Note amount the Trust has paid Michael $3,535. So it could be that Michael has a $200,000... $300,000 Note signed that the Trust owes him money for something. So when they are saying that the Trust only has $50,000 in it it could actually have $50,000 + the amount of the Note from Terri to Michael. Again the Promissory Note is Terri owes Michael, NOT the other way around.
The newspaper said that Judge Greer approves all the expenses coming out of the Trust.
Thak you to the freepr(s) who found out that you can't use Medicaid money to starve and dehydrate some one. We know know why they are not using her medicaide money to pay the Hospice. I find it ironci that the Hospice is not getting paid. Michael is her loving husband (so he says) why isn't the Hospice coming after him for her expenses? Hell he got a huge settlement he has assets, they are not doing their fudiciary duty by letting Terri have a free ride over there not gong after her husband to pay the bill.
Aparantly she is staying out of "Charity" yeah, charity for the rich I would say...
Michael can't have it both ways, "I am her husband so I and I alone have the authority to kill her becasue I am her husband" and yet when it comes time to pay the bills for his wife stand mute as if he is not responsible.

Only if it's ENRON. Seriously, though: as a non-corporate entity, if your name is in the business title, you do not need to file a fictitious name form because the "business fiction" contains your name - you, the owner, are not operating it under fictition. You are liable as the owner and there is no question who you are. If you want a different name for your company, you file the ficitious name form w/ the state and in some states, are required to publish the fact in a newspaper and legal journal - making public that Krodg is starting a business called "Super Internet Searches." Depending on the state, banks and utility companies require the fictitious name filing before they will open the account. Your checking account will just have "Super Internet Searches" with no d/b/a. If you put your name to it: Krodg's Super Internet Searches, then that would be the first line of your accounts (but no filing required) and the second line would be d/b/a Krodg. Either way, you are liable. That's why you incorporate and put all your personal assets in a trust. ;)
To be on the safe side, always register no matter if you are using your name or not....your competitor, Nicmarlo, just to confuse the public and gain market share, could register YOUR name, and then turn around and sue you because you are operating under an already licensed name belonging to Nicmarlo.
It's not only protection for the public, it's also protection for you, the owner. No one can take your business name.

The law justifies Judge Greer's court. This case has been on appeal four times and his opinions have been upheld four times- five if you count the FL Supreme Court rejection.
Yes, Felos knows the "right to die" laws extremely well. He was instrumental in getting the law passed designating feeding tubes as life support. This is his field of expertise. The Schindler's were totally blindsided by this - imagine, having this situation happen literally overnight - their lawyers have been dedicated, but inexperienced in this type of lawsuit, working mostly pro bono. Much of the problems seem to come from procedural mistakes. I mean no disrespect to the Schindler's team, but they have been out-lawyered. Bigtime.
Just because Felos/Schiavo are winning, doesn't mean they're right. And this isn't over yet.

If you are using your name (for example - Jacobs and Gregory Auto Parts) you do not need to file a fictitious business name statement because you are actually using your name in the business.
Does that mean that both names are part of the company? Or does it mean that you can put any legal name out there and not be held accountable?
If you are a sole-proprietorship or a partnership, you and the company are legally one entity. The use of a fictitious business name has no effect on the protection of your personal assets, that is, being liable for all of your company's debts, or being subject to lawsuits and such. If you are a corporation, your personal assets are generally protected from liabilities and lawsuits against your company. GENERALLY speaking - if you don't pierce the "corporate veil".
The use of a fictitious business name is really more of an administrative thing. If you want your business to be known as "John Smith Company", you don't need to register a fictitious business name. If you want to call it Big John's Deli, then you would register a ficticious business name.

Okay...Michael Schiavo is not the same as Jergers & Centonze. He is not JERGER or CENTONZE so he should file for a fictitious name?
No, because they are a corporation. They wouldn't need to, because as a corporation they would have to file incorporation papers, where they would designate their corporate (company) name. different rules for corporations. Confusing, isn't it?
Actually, I went back to look at Florida's corporations database, and the only record they show is the dissolution of the corporation in Jan. of 2001. They would have had to file their incorporation papers, and then annual filings after that. I wonder why it only shows the one record? I wonder when they initially formed the corporation?
