Sen. Richard Blumenthal, D-Connecticut, suggested that President Trump's pick to fill the vacancy on the Supreme Court should recuse themselves from any potential court decisions that relate to the special prosecutor's ongoing investigation into the Trump campaign's possible ties to Russia.
"The president should not be permitted to appoint a justice who will decide whether or not he complies with a subpoena to testify before a grand jury or pardons himself," Blumenthal said on "Face the Nation" Sunday. "I believe that whoever is appointed ought to recuse himself and commit to recusing himself from those kinds of decisions that affect the personal finances or the special prosecutor investigation."
Special counsel Robert Mueller has sought an interview with Mr. Trump about his campaign's connections to Russian nationals and potential efforts to obstruct justice while in office. Rudy Giuliani, the president's attorney, has said that he would fight any attempt by Mueller to issue a grand jury subpoena and compel Mr. Trump's testimony, which could set up a legal challenge that potentially makes its way to the Supreme Court.
Blumenthal also said that an upcoming meeting between Mr. Trump and Russian President Vladimir Putin in Helsinki on July 16 is "deeply alarming."(continued)

The presidents pick may end up having to rule on issues having to do with the Mueller investigation. Neil Gorsuch didnt come up he came up before there was a Robert Mueller special counsel. Now he exists. Do you believe this nominee needs to commit to recusing him or herself or anything having to do with the Mueller probe directly right now if it makes its way to the Supreme Court? Chuck Todd asked Graham on Meet the Press on NBC Sunday.
Ive been a lawyer before I was a politician. To recuse yourself is proper in some cases, Graham told Todd. The idea you cant judge someone who picks you is not a good grounds for recusal. There is a difference between the case at hand and the judge. It makes perfect sense that Jeff Sessions cant oversee an investigation on a campaign he was a part of, but I wouldnt have a broad rule you cant review anything about President Trump because he chose you....

I want to hear them reply, “Senator, per the U.S. Constitution a sitting President is not subject to prosecution for any crimes and therefore cannot be compelled to testify in such cases. However the Constitution provides for a means whereby a sitting President may be indicted and removed from office and that is called impeachment. If you had been awake and paying attention during high school civics class you would have known that and not had to ask me such a stupid f*cking question”

Sen. Richard Blumenthal it isn’t up to the SCOTUS to judge the Executive branch. The only way to do that is Impeachment by Congress with the Chief Justice presiding. Any issue of Presidential privilege brought to the SCOTUS is moot.
You know....that’s the real solution to dumping Sessions. ‘Fire’ him by offering him the seat to the Supreme Court. That would really make things interesting.
