ok...will a garter snake have markings or not? or does it matter? does a baby rattler make rattle noise?

No a baby rattle snake will not make a noise. Most likely if it's head is not triangular it's harmless and will eat alot of insects in your garden. Try to sweep it into an open area with a broom then cover with a container until animal control can get there.

Baby rattlers usually have little rattles. Depending upon what part of the country you're in, they would probably be a lighter brown color -- not the greyish-brown that you're describing.

Chances are 1000 to 1 from your description that it's not poisonous (hey, I'm an Eagle Scout!). Remember also that you're 100 times taller than he is and that he doesn't have any arms or legs, so just imagine how scared the poor little feller is.
