Beginning with its 2008 Heller decision, culminating in the 2022 Bruen decision, the Supreme Court made clear three primary--and many other--things:
SNIP
Never mind the gun confiscations and abuses of liberties that could follow and provoke a second civil war. They’re building a paradise, and they won't let a trifle like the Constitution get in their way. In the meantime, honest Americans suffer:
According to an account from the Associated Press, on September 28, a 22-year-old off-duty specialist with the Oklahoma Guard deployed to Washington, D.C., as part of an ongoing safety task force was traveling in an SUV with another National Guard member when they were stopped by U.S. Park Police over an expired tag. Upon approaching the vehicle, the officer reportedly saw an empty holster inside. When the guardsman was asked if there was a firearm in the vehicle, he responded in the affirmative.
The AP story went on to explain,
One officer said the soldier told authorities he was temporarily living in D.C. as part of the National Guard operation and said Oklahoma was an open-carry state and that the firearm was registered to him there. He acknowledged he did not have a valid District of Columbia concealed-carry permit, the statement said, a point confirmed by a records check.
According to the complaint, [soldier] was charged with carrying a pistol without a license.
That’s a felony charge. If convicted, and that's the way to bet in DC, the Guardsman will lose his Second Amendment rights and may be dishonorably discharged.
Consider the irony. A Guardsman leaves family and home to protect the citizens of the District, when their elected Democrat leaders will not. They protect armed, violent criminals, not the honest citizens they were elected to serve.

Stay out of communist countries and stay out of communist, blue cities.
Father, in the Name of Jesus, please confound the enemy on behalf of this young man. Amen.
Lol, with Trump, Janine Pirro and Hegseth on his side, plus 65% of America, I doubt the soldier has a lot to be worried about.
What a confused muddle. If you deploy you are on-duty.
So he’s ordered to DC and required to carry a weapon, but is arrested for carrying a weapon. Amazing.
Anarcho-Tyranny. It's everywhere.
The world is an odd place:
A national guardsman tasked with protecting people and the nation, travels with a weapon and gets potentially gets a felony. This felony would remove many of his rights, including the right to bear arms. Why a ‘felony’ should permanently remove someone’s Constitutional rights, I haven’t logically come to terms with, but this is true. The fact that he was endangering no one, and inside his personal vehicle for self protection, makes the ‘felony’ look like another law to block the second Amendment.
I see this aforementioned. Simultaneously, I see a special prosecutor who used his position for political spying. That same prosecutor, and administration that appointed him, also used political actions to debank people they ideologically disagreed with. Yet he walks through Congress and attends Bruce Springsteen concerts, wearing (laughing), a no kings shirt. He has not been endangered or threatened with a felony, and retains his rights.
It’s a very funny world, that just isn’t humerous. I hope this guardsman does not get ‘convicted’ but if he is I hope that a rational Supreme Court hears the case quickly and decides if laws that prevent ‘self protection’ of normal individuals are ‘infringing on the right to bear arms’.
The DC mayor must be arrested for being Black.
Black insurrection in the Nation’s capital is a crime against the Republic
Amen & Amen!
Many years ago I went to a talk given by an NRA lawyer. He listed the top three cities where the cops will happily arrest you for a gun crime, even if you are following every gun law perfectly.
The three: DC, Baltimore, and New York City.
And if you have actually broken one of their anti-2A laws, you’re in even more trouble.
“According to the complaint, [soldier] was charged with carrying a pistol without a license.”
There have been a case or two where staffers of liberal members of Congress have been caught bringing firearms into congressional office buildings - nothing happened to them.
I expect the Trump team will handle this incident in an appropriate way.

Yeah, orders don't have "From the start of the duty day to the end of the duty day."
Most have a start and end date. Many don't have an end date.
> I expect the Trump team will handle this incident in an appropriate way. <
I just looked it up. The president can only pardon federal crimes, not state crimes. But DC is a special case. The president *can* pardon a crime against DC codes.
So Trump can act here. A fast pardon would be most appropriate.
The Republicans control the House, Senate, and White House and there is still no universal carry. At times, the White House has fought against our rights under the Second Amendment.
Too many as wholes like the power more than actual passage of meaningful legislation.
Not enough "in control" numbbers to overcome inertia.
The crime happened in DC, so I imaging that Trump can issue a pardon.
So? The DC prosecutor will just decline to prosecute like they do for other cases they think the state doesn’t have a legal justification for.
Oh… they won’t do that here? Huh…
I don’t quite understand this one. I was violating FR protocol and reading the linked story but hit a subscription wall. Maybe my questions are answered on the other side of the wall.
First, note that this guy was stopped by the U.S. Park Police, which is a significant presence in DC, as are the Capitol Police, the Metro Transit Police (multi-jurisdictional, not just DC), the FBI, and the Secret Service, both uniformed and plainclothes. There are myriad other specialzed police agencies, including military and diplomatic security, but the above are the big ones.
Anyhow, U.S. Park Police are federal, so whatever they did, direct your attention to Trump and Trump appointees. But in any event, stopping a car for expired tags is pretty basic, as is inquiring about firearms and concealed carry if an officer sees something lying in plain view in a civilian vehicle. We don’t know if the National Guardsman was in uniform at the time. That might have made a difference to the officer’s judgment call.
You might be aware that DC has a gun violence problem, so vigilence on the part of the officer is a good thing. A LOT of gun and drug busts start with routine traffic stops.
You might also be aware that DC has a soft on crime mayor and city council that have shackled the DC MPD, lest too many aspiring rappers who are turning their lives around get tagged with criminal records. But even DC MPD is supposed to be vigilent on guns, although our feckless mayor and city council are soft on everything else.
The next question here would be prosecutorial discretion. The prosecurors in DC are federal. It’s hard to keep track of Trump’s shambolic misfires when it comes to staffing his administration, but this will be a federal case if it goes forward.
