JEFFERSON COUNTY, Ala. (WBRC) - An Alabama woman has won a lawsuit against a Church’s Chicken location in Midfield after a bench trial this week.
According to the lawsuit and her attorney, Yolanda Jackson was burned by a Church’s chicken pot pie in January 2020 that she ordered in the drive-thru. According to court records, “Church’s sold chicken to Yolanda Jackson that was too hot for human consumption”.
Jackson suffered serious injuries to her mouth, face, lip, left wrist and body, including second degree burns, according to the lawsuit.
“What bothered her the most was that she was left scarred, and she felt unheard by Church’s,” Truman Fitzgerald, Jackson’s attorney posted on Facebook.
On Monday, the case was in Jefferson County Circuit Court in Bessemer.
After hearing testimony and seeing the evidence, the court on Wednesday ruled in favor of Jackson and entered a judgment against Church’s for $20,000 plus court costs.

I'm guessing those areas meant she simply picked it up and start eating it out of the container - without utensils?
First replace the restaurant staff with robots. Next replace the customers.
Hard to believe that an adult could not perceive that the temperature was too high for her to put the food in her mouth.
She was HONGRY!
Stupidity should never be rewarded.
Not that I’m encouraging these kinds of lawsuits, but as judgement awards go, $20K is sort of Low Balling it.
If I felt so injured as to sue a fast food place,
my suit would be for at least $50K.
$20K is the sign of somebody who wants to sue for damages, but doesn’t really expect to win.
There is a reason why they put caution stickers on lawnmowers telling people not to reach under the mower while it is running.
According to the Chicago Tribune, the Church's Chicken/KKK story was prevalent in the '80s in the African American community, although most white people never even heard it. NewsOne goes on to explain the myth in greater detail.Allegedly, not only was the Church's Chicken said to be KKK-owned, but the accusation also goes that they were somehow introducing a certain substance into the chicken that would render Black men impotent.
According to folklorist Patricia Turner, this myth was lent a certain appearance of veracity by the fact that many Church's franchises tend to be located in neighborhoods whose inhabitants are primarily African American.
$20k? Sounds like insurance settled for cost of defense. Looks like fair pay for an insurance defense guy in Birmingham is around $250 an hour (I would have guessed more) and paralegals at say $75 an hour. That would be about 60 hours for prep and trial (and that doesn’t include the in-house resources at the insurance company and a day’s worth of time for a mediator, which they may have already spent to get it to settlement).
What is most shocking to me is that anyone is willing to take the risk to have a business reliant on the idiot and dangerous population we have now.
I darn sure would not want to own a restaurant with any Yolanda’s for customers.
I’ve eaten pizza fresh from the oven at the pizzaria and burnt the roof of my mouth more than once, and I’ve never sued anyone because of my own stupidity.
It’s too bad she didn’t set her head on fire. That would have been a nice ambulance chaser lawsuit.
No one should benefit from events like this, and until juries and judges stop awarding them for their scams this will continue. Your order stopping hot expect something hot.
Let me get this straight. A jury awarded someone $20,000 because their Hot Apple Pie was actually hot? I would understand if the Hot Apple Pie had been served frozen and she broke a took but even then anyone who so stupid to feel that something they are getting ready to put in their mouth is not too hot and then let it cool.
She must’ve tried to wolf down the pot pie. I have ate Banquet chicken pot pies for years. I’ve learned that you wait for them to cool down before eating. There are ways to tell if they are too hot to eat. One is the butter melt trick.
I am guessing you have never had pizza burn to the roof of your mouth. The liquid part of pizza (sauce) and I am sure the gravy in the pot pie can keep extremely high temps while the top cools down.
I usually wait for a “chicken pot pie” to cool down before I eat it. I guess I’m some kind of a genius.
What the hell did she do? Smear the pot pie all over herself? Geez, Morons in this country are stupid.
So she is trying to eat a chicken pot pie in her car????!!!
You can’t fix stupid, but it pays good money if you like to sue.
