PLYMOUTH, Mass. – A judge declared a mistrial in Lindsay Clancy’s murder trial Friday on the seventh day of deliberations — but gave her defiant lawyer one hour to file an emergency appeal against the ruling.
The 12-person jury – made up of nine women and three men – told Judge William Sullivan that they could not agree on whether to convict Clancy, 36, of three counts of first-degree murder.

I would have killed the b__h in the house that day, or the yard as she laid there. Consequences be damned you just lost your whole family.
The defense is going to file an appeal that the hung juror should be replaced and deliberations should continue. The basis is the belief by the defense that the juror was unwilling to follow the Judge’s instructions.
So, the jury will be sent home. The Supreme Judical Court (The MA Supreme Court) will rule on it…(on Labor Day weekend—good luck with that) and we pick it back up on Tuesday.
This case is a mess and should have been settled before it even got to court.
I heard somewhere else that there was one person not to convict but this makes it sound like the defense lawyer believes the opposite?
If it was really 11-1, will the prosecutor try again? Is there a reason to believe it would turn out differently next time?
Seems about 1/4 of freepers think she is either innocent or shouldn’t be convicted. God help us!

The general assumption is 11 to aquit and the one hold out is a guilty vote that refuses to change their mind.
That would explain why the defense was lobbying so hard to have the one removed in hopes of getting an alternate to go along with the other 11 and aquit.
I think everyone is mixing up religious terms with sports terms.
Mary had the “Immaculate Conception”.
Franco Harris had an Immaculate Reception.
Doug Flutie’s pass against Miami was a Hail Mary.
And Staubach to Drew Pearson was a push-off.

I’m hoping it’s the other way around. But you’re probably right.
If it is a male who is preventing an acquittal, his life will be a living hell from now to eternity. The AWFULs will see to that.
It seems to me the public would demand they retry.
The judge should have sequestered; and I don’t think the prosecution presented as effectively as it should have. But in general, I think judge, jury, lawyers have fulfilled their roles properly.
It wouldn’t necessarily turn out the same way in a retrial, with a different jury..

Unknown, but hopefully the holdout will prove to not be a pussy. Those types generally have more success at fighting back.
Highly doubtful. The instructions given to the jury told them it only needed to be unanimous for the 1st degree charge. 2nd degree would have been a majority, and that would have happened. It was therefore 1st degree vs mental.
I WILL call them cowards or evil demons...
