Living With HIV Shouldn’t Make You a Criminal

...in 2026, according to the Community Health Law Project (CHLP), "32 states criminalize people living with HIV (PLHIV) and 28 states have harsh criminal penalty enhancements that elevate charges based on a person’s knowledge of their HIV status."

There are many examples of the harm these laws do. One that stands out to me is Robert Suttle. I met Robert last year when he was a guest on my cable access TV broadcast, The Recruiters with Tom Duane. In 2008, Robert was arrested at his workplace after a former partner accused him of failing to disclose his HIV status. Robert countered that he had disclosed his status and that the sex was consensual. Also, no HIV transmission occurred. Robert accepted a plea deal and served six months in a Louisiana prison. He was also required to register as a sex offender for 15 years.

The consequences extended beyond incarceration. Robert described losing his career and dealing with the effects of being labeled a convicted felon and sex offender. He is now a prominent advocate against HIV criminalization.

Well, actually, according to what you say you BROKE it - if you wanted to fix it they way your explanation suggests you wanted to strike ONLY the word “protected” in my statement. You left it in.

The act is STILL A CRIME by causing alarm through a fear of injury. That’s why bank robbers with a fake gun can still be charged with armed robbery.”

Further, the person on the business end of that gun often HOPES to take the bullet. They have parties to accomplish this.

The gun isn’t pointed at each other, it’s pointed at the rest of society. And that’s why it should be illegal.

Oftentimes the “bug chasers” will try to hook up with the “gift givers.” Both groups have a pathological fantasy about the “transaction” that gives them a perverted rush.

I couldn’t in a million years understand this thinking.

When they ATTEMPT - whether transmission is successful or not - then it’s criminal. It’s akin to attempted murder.

it probably would, however I remember the Federal Bureau of Prisons only Tested 1 in 10 of incoming prisoners To keep from stigmatizing new prisoners. even if they were also victims of illegal exposure to HIV they should have maintained punishments for knowingly infecting others.

Yes, every HIV infection is a threat to society through "leaks." Ask the thousands of hemophiliacs who died in the 80's and 90's.

Donating blood helps to prevent having excess iron. (but donating too much causes an iron deficiency)

I was pointing out that we cannot give blood( on a list) but fags can. That was my point.

I have always enjoyed irritating people in Eugene OR by my innocent comments at work and elsewhere. I try to live my life in such a way that I can take as much comfort in the enemies I make as in the friends that surround me. It is nice to know there are some people I will never have to speak to again.

At the very least, if you transmit HIV to another person you should be held liable for their lifelong medical treatment for the condition.
