There are many examples of the harm these laws do. One that stands out to me is Robert Suttle. I met Robert last year when he was a guest on my cable access TV broadcast, The Recruiters with Tom Duane. In 2008, Robert was arrested at his workplace after a former partner accused him of failing to disclose his HIV status. Robert countered that he had disclosed his status and that the sex was consensual. Also, no HIV transmission occurred. Robert accepted a plea deal and served six months in a Louisiana prison. He was also required to register as a sex offender for 15 years.
The consequences extended beyond incarceration. Robert described losing his career and dealing with the effects of being labeled a convicted felon and sex offender. He is now a prominent advocate against HIV criminalization.

First, NO ONE is criminalized for "having HIV," EVER!
Second, people are STILL CONTRACTING HIV by the thousands every year, despite all of the medical advancements to mitigate and avoid infection, as well as aggressive education on nearly every t.v. channel. The possibility of contracting HIV is still a real threat, and this include innocents in healthcare and blood recipients.
If I were king for a day, I would make every actual transmission of HIV through sex a federal felony, punishable by a minimum of 20 years hard time. That would kill the epidemic faster than any tepid efforts suggested.

There is a sick sect of homosexuals that are called “bug chasers” who will just ride raw wherever and with whoever. We can thank them for bringing in primate diseases from the dark continent. But hey. The aids lobby gets billions so keep riding raw homos.
No. Living with HIV should not make you a criminal.
But failing to report HIV status before engaging in unprotected sex or any other activity that might risk transmission should and in many states is a crime. So, do that and you’ve committed a crime.
It *used* to be that HIV positive people or those who engage in risky sexual behaviors weren’t allowed to donate blood. That should always have been a crime, but wasn’t, and they relaxed it a lot but shouldn’t have.
Additionally, TV ads that say, “undetectable = untransmissible,” are at best hopeful lies and that should be criminal as well, but is not at the moment.

And consider this. You are only as “HIV-negative” or “undetectable” as the days or hours after your last blood test, and even that is indeterminable due to the 2-week to 1-month window period of undetectability for new infections. You can show your “clean” certificate to all of your new Grindr “dates” and yet still be a walking plague of infection flying under the radar.
Undetectability is not a static status. I read that its not uncommon for HIV carriers to have unexplained spikes in their virus counts, whether due to not remaining perfect enough in their HIV med regimen; contracting a new, drug-resistant mutation from a new sexual partner, or the current drugs just becoming ineffective. And you won’t likely know this for months since your last HIV exam. In that time frame, you could have exposed dozens of people to an active virus, despite your impotent assurances of “U = U.”
I think it should be illegal to knowingly fail to reveal any STD to a sexual partner not just HIV. The new generation of STDs are very resistant to treatment so should be treated as the serious health threat that HIV is.

The people who are at risk know good and well that they might harbor pathogens that they can easily transmit to a sex partner. In my books, all STD's are culpable acquisitions.

How is someone NOT a murderous perpetrator for failing to disclose they have a disease that can kill you, if you have sex with them, and why should the virus be held responsible to speak up? By the way, why should normal people cower when the words homophobia, transphobia, and racism are spoken?
But what the government did do, in 33 states, was enact laws criminalizing a person living with HIV if they didn’t disclose their HIV status before a sex act. These laws were born out of misplaced fear, painting the HIV-positive person as a murderous perpetrator, looking for any reason to expose an innocent person to the virus, to transmit HIV, and to kill the innocent victim with AIDS. I say the fear was misplaced, because it was focused on the person carrying the virus, not the mysterious virus itself, which was causing sickness and death. These laws were also rooted in homophobia, transphobia, and racism.

There is no trial, no judge, you do not get to confront your accuser and there is no appeal.

The person targeted by the handgun has every rational reason to fear that his life or health is in serious jeopardy by such an act, despite the gun pointer knowing that the gun isn't loaded. The act is STILL A CRIME by causing alarm through a fear of injury. That's why bank robbers with a fake gun can still be charged with armed robbery.
And there is still the possibility that the gun wielder is mistaken about the gun being unloaded. Perhaps he emptied the magazine but forgot about the round in the chamber.
HIV laws are modeled after the innate fear transmitted to the uninfected party, not the actual possibility of the infection being transmitted.
