MINNEAPOLIS (FOX 9) - FOX 9 has learned the Department of Justice will not seek the death penalty against Vance Boelter, the man accused of shooting two Minnesota lawmakers and their spouses, after prosecutors determined the crimes he faced were not eligible under federal law.

The backstory: Boelter is accused of shooting House Speaker Rep. Melissa Hortman and her husband Mark Hortman in their Brooklyn Park home, as well as shooting Sen. John Hoffman and his wife Yvette Hoffman in their Champlin home on June 14, 2025. Prosecutors also allege that same morning he stopped at the Maple Grove home of Rep. Kristin Bahner while she and her family were out of town, then later drove to the New Hope home of Sen. Ann Rest, and left the scene after encountering an officer who was conducting a welfare check.
A federal grand jury indicted Boelter on six counts related to the attacks of the Hortmans and Hoffmans, including stalking, murder and firearms charges. Federal prosecutors were deciding whether to pursue the death penalty in the case. However, sources tell FOX 9 that ultimately prosecutors determined that the crimes Boelter faced were not eligible for the death penalty under federal law.
What they're saying: "Bringing justice to the families and loved ones of victims of violence is the number one priority of the Department of Justice," a DOJ spokesperson said in a statement. "Prosecutors worked hard on this case to make sure he was held accountable to the fullest extent possible."
Dig deeper: In state court, a grand jury indicted Boelter in August 2025 on multiple charges, including first-degree premeditated murder in the deaths of Melissa and Mark Hortman and attempted first-degree murder in the shootings of John Hoffman, Yvette Hoffman and Hope Hoffman.

Much of the population and our leaders have no concept of Justice and a misplaced concept of mercy / compassion.
This causes many to allow for the assuaging of their feelings not wanting to be held accountable for the hard decisions needed to deal with real acts of evil.
The natural result of feminizing and infantilizing the population through media and education.

"not eligible", I think, implies that his crime wasn't serious enough to warrant such a charge in the first place. That's crazy.
If he was an American loving conservative republican he would have fried weeks ago.
Did they cite the written words which took Capital off the menu? This guy is holding keys to a lot of locked doors and the DOJ has to explain why Capital is gone, without tipping off the targets which would be now under investigation, that the assassin grew a beak. Or not, I don’t know.

Both Hortman and Hoffman were members of the Democratic Party-affiliated DFL. Federal charging documents described Boelter as acting with “the intent to kill, injure, harass, and intimidate Minnesota legislators”. Governor Tim Walz called the shooting “an act of targeted political violence”. Inside Boelter’s vehicle was a list of nearly 70 people, including abortion rights advocates, Democratic politicians, and abortion providers.
A longtime Sleepy Eye, Minnesota resident who knew Boelter since he was a fourth-grade student in his childhood town in 1976 told reporters he was stunned to learn that Boelter was a suspect in the attacks. He described Boelter as “a conservative who voted for President Donald Trump and was strongly against abortion rights”.

Unless, of course, Tim Walz and Keith Ellison end up in jail as a direct and immediate result of his testimony. Does he know anything about Hillary Clinton? That might lead to action as well.

None of that is true. More importantly society is best protected when murderers are quickly prosecuted and executed. The prosecutors have utterly failed a very simple task.
Why the federal charges? Murdered is typically a state charge.
