The Justice Department on Friday dropped its criminal investigation into Fed Chairman Jerome Powell.
This clears the way for Trump’s Fed Chair nominee Kevin Warsh to be confirmed.
Senator Thom Tillis vowed to block Trump’s Fed Chair confirmation until the Justice Department dropped its investigation into Powell.
US Attorney Jeanine Pirro made the announcement on Friday morning:
"This morning the Inspector General for the Federal Reserve has been asked to scrutinize the building costs overruns – in the billions of dollars – that have been borne by taxpayers.
The IG has the authority to hold the Federal Reserve accountable to American taxpayers. I expect a comprehensive report in short order and am confident the outcome will assist in resolving, once and for all, the questions that led this office to issue subpoenas.
Accordingly, I have directed my office to close our investigation as the IG undertakes this inquiry. Note well, however, that I will not hesitate to restart a criminal investigation should the facts warrant doing so."

I love it that the media is now using derivatives of “drop” to actually mean what they say, rather than using this verb to mean just the opposite! The way they change common words to negate their actual meaning is very confusing! You would think that journalism school would teach them not to do this.
I saw that. I don’t believe they would actually drop it off they thought they had a good case, but we’ll see. I think the President tends to push political prosecutions that lack legal merit.

“Criminal probe”??? On cost overruns at a federal project??? And an allegation that someone testifying to congress about it “lied”? How often do members of Congress lie in their own testimonies (speeches) in Congressional “investigations” , every day, and never get prosecuted for “perjury”.
O.K. Powell (whom Trump appointed to the Fed) has not been a stellar Fed Chairman, and Trump feels his advisors advised him badly in choosing Powell, and Trump would like lower interest rates than Powell has achieved. “Criminal probe”??
No. Trump wanted Powell out sooner, and that’s it, period.
Tillis was right, drop the stupid “investigation” and get Trump’s new fed appointee confirmed, and move on.
It has nothing to do with Tillis being in anyone’s pocket.

Get your new guy confirmed.
Restart the investigation.
Rinse and repeat.”

If it was dropped in the “furtherance of justice,” the indictments can’t be brought before a Grand Jury again. I’d also bet that the court dismissed the indictment “with prejudice,” which also forecloses future charges.
Even if Trump’s guy is confirmed, Powell doesn’t have to leave the Board of Governors, and the Chairman is just one vote out of 12.
There is no indictment. There was never going to be indictments. The whole, manufactured mess was lawfare at its worse. Everyone in Washington, including the dim Tillis, knows it. Move on.
Both statements are too absolute and usually wrong in practice.
Dismissal “in the furtherance (or interest) of justice” is a discretionary decision by the court—basically: continuing the case would be unfair or not serve justice. By itself, that phrase does NOT determine whether charges can come back. The key question is with or without prejudice, not “furtherance of justice.”
Dismissed with prejudice = final, Prosecutors cannot refile the same charges.It’s treated as a final adjudication (similar effect to a not-guilty outcome for that charge).
BUT—two important caveats: Caveat A: It must actually be “with prejudice”. Courts do not default to this—it’s relatively rare. Prosecutors themselves usually seek without prejudice if they want flexibility.
Caveat B: Scope matters. “With prejudice” bars the same charges based on the same facts. It doesn’t always prevent: Different charges based on different facts, or charges from a different sovereign (e.g., state vs federal)
Nor is there any public indication that the charges were dismissed with prejudice. In fact, I'm unaware that the DOJ made any pitch to a Grand Jury or a court at all. An internally-sponsored investigation could be turned on or off at will.

Sorry, but I want an investigation into why it’s costing over a billion dollars to renovate a Federal building. Trump knows, and so do I, that there is something very wrong with that number and it would point to monkey business in the construction process. Very common generally in the business but this situation is beyond believable on the surface. Any improprieties need to be prosecuted.
