@DineshDSouza
He hasn’t paid income tax in over 30 years and claims he hasn’t gone to jail because Americans are not legally required to file…..
@PeterSchiff
My father also said, “Show me the law.” He coined the term “confession” to describe the 1040. Though the government never showed him any law that required him to pay income taxes or file an income tax confession, corrupt judges orchestrated convictions to protect the government.

Really want to settle this hash...?
Repeal the 16th Amendment.
Ask Wesley Snipes how that plays out.
There may not be a statutory requirement.
There are plenty of regulations. Plenty of ways to punish you if you do not file.
Lots of people have been badly hurt by following Schiff’s bad advise.
There is theory, and there is reality. Reality wins.
“The Law that never was”, is a fascinating story and I encourage everyone to watch and read all about it.
Yes. The judiciary will back-up the government
That’s the issue.
As ai understand it:
If you already had too much money taken out, you are allowed to leave it with the government and not file.
You also don’t need to file if you didn’t make enough to meet the standard deduction.
They are both wrong, assuming the referenced individuals really said that.
Leo AI:
Is It Legal to Not Pay US Income Tax?
In short: No. Deliberately not paying US income taxes is illegal and can result in serious consequences.
The Law
The requirement to pay taxes is clearly established in Section 1 of the Internal Revenue Code, which imposes a tax on the taxable income of individuals, and Section 6151, which requires taxpayers to submit payment with their returns
Failure to pay taxes can subject individuals to criminal penalties, including fines and imprisonment, as well as civil penalties
The “Voluntary” Misconception
A common myth is that the tax system is “voluntary.” The word voluntary refers only to taxpayers being allowed to calculate their own tax liability, rather than having the government do it for them — it does not mean payment is optional
Courts have consistently rejected this argument. In United States v. Gerads, the court stated that the claim that payment of federal income tax is voluntary “clearly lacks substance” and imposed $1,500 in sanctions for bringing a frivolous appeal
Legal Ways to Reduce Your Tax Bill
While you can’t avoid taxes entirely, there are legal methods to lower what you owe:
Contributing to tax-advantaged accounts (401k, IRA, HSA)
Claiming eligible deductions and credits
Timing investment gains/losses strategically

If you believe you owe an incorrect amount, you can contest it through services like the IRS Taxpayer Advocate Service, which is free

That is, “As I understand it…”
Still waking up.
“Show me the law.” It’s the 16A, of course.
Those folks love to play word games. We also see that with people who do not believe they need a driver’s license. It’s because they are not driving, they are “traveling”.
That kind of thinking gets them traveling right to jail.
I think the AI will tell you whatever its programmed to.
No one disputes the amendment it’s the “filing”.
The whole thing is an an esoteric argument but it’s one adherents insist upon. “Code” to file or regulations are not the same as “law”.
And yeah I’m not suggesting it whatsoever they will make an example out of anyone like they did to Irwin Schiff
Show me the law!
IRS: “Show me the money”
In United States v. Tedder, 787 F.2d 540, 542 (10th Cir. 1986), the court stated that, “although Treasury regulations establish voluntary compliance as the general method of income tax collection, Congress gave the Secretary of the Treasury the power to enforce the income tax laws through involuntary collection. . . . The IRS’ efforts to obtain compliance with the tax laws are entirely proper.” The IRS warned taxpayers of the consequences of making this frivolous argument in Rev. Rul. 2007-20, 2007-1 C.B. 863 and in Notice 2010-33, 2010-17 I.R.B. 609.
“”””Those folks love to play word games. We also see that with people who do not believe they need a driver’s license. It’s because they are not driving, they are “traveling”.
That kind of thinking gets them traveling right to jail.””””
Yup. These Sovereign Citizens spend months researching their ‘traveling’ arguments. When all these folks need to do is watch a few of the hundreds of YouTube videos where the ‘traveling’ defendents are found guilty by the judge and sent to jail.
The AI quoted the relevant law and court precedent.
26 U.S.C. § 6012 — summary
Establishes who must file a federal income tax return.
General rule: individuals, estates, and trusts whose gross income equals or exceeds specified amounts for the taxable year must file.
Specifies filing thresholds and special rules for: married filing jointly, dependents/minors, nonresident aliens, estates and trusts, and certain exempt or tax‑preferred income.
Requires inclusion on returns of tax‑exempt interest and treats certain exclusions (e.g., foreign earned income, gain on sale of principal residence) as includable when determining whether a return is required.
Authorizes Treasury/IRS to prescribe rules for joint fiduciaries, agents filing for taxpayers, and other procedural specifics.
I guess the 16th can ignore this little part?
I’m sure there are counter arguments. I’ve not read Schiff’s book but they do have - what I described as esoteric - their own arguments and some are insistent/prepared to go to jail
Generally speaking, if taxes withheld exceed your actual tax liability, then you won’t get in trouble for not filing.
You need to file in order to get any refund or claim deductions.
If you know your liability and aren’t having money withheld by employers and brokers, you can just pay sufficient estimated tax throughout the year.
If the liability exceeds what was paid and you haven’t filed, you will get additional fines on top of the fines for not paying enough.
