Green Bay Packers offensive lineman Rasheed Walker was arrested Friday morning at LaGuardia Airport in New York after authorities say he attempted to check a bag containing a handgun and ammunition. Walker, 25, was taken into custody at the airport's Terminal C after telling a Delta Air Lines employee that his luggage contained a locked box holding a firearm, according to a criminal complaint obtained by the New York Post.

Port Authority police were alerted and searched the bag, where they found a 9mm Glock pistol and 36 rounds of ammunition secured inside the locked case.

Walker was charged with two counts of second-degree criminal possession of a weapon and one count of criminal possession of a firearm. He later appeared in Queens County Criminal Court on the gun charge and was released on his own recognizance. He is scheduled to return to court on March 19.

Walker's attorney, Arthur Aidala, said the incident stemmed from a misunderstanding and that the firearm was legally licensed in Wisconsin, adding that Walker was unaware he could not travel with it in New York.

"It was in a locked box and he disclosed it to the people at the airport," Aidala told the New York Post. "He told a person from Delta he was traveling with a firearm. He mistakenly thought because he had a licensed firearm and it was in a locked box that he was able to travel with it. We are confident the case will be dismissed."

Some do. The only thing he did wrong was make it a carryon. I’m surprised if he told Delta he had it, they didn’t require him the check it into luggage but let him carry it on. They screwed up. He didn’t do what he was supposed to and they knew but screwed up at the original airport. That is if he actually told them he had it at the origin airport.

In checked luggage, declared to the counter attendant. Illegal in NY, also NJ I believe.

He declared it. Not a lawyer, but I’ve been told that if I have a checked bag with a firearm properly declared, if my flight is rerouted to NY or NJ, NOT to take possession of my luggage at risk of illegal possession of a firearm under state law. Let the airline forward it somewhere, but do not take possession of the suitcase. From a knowledgeable non lawyer source, maybe someone else here can confirm or debunk it.

I stand corrected. I forgot that NY has that goofy licensing requirement. In 99% of the rest of the country, if you check your bags and declare the gun, you are fine.

Two things I noticed on the New Jersey Firearm Owners Syndicate website

The Safe Passage clause of FOPA only protects individuals transporting firearms. Firearms accessories such as magazines, are still subject to local laws. As such it is illegal to travel through New Jersey with any magazine with a capacity greater that 10 rounds.

The Safe Passage clause of FOPA does not apply to air travelers. Flying into NJ with restricted firearms, even if your intent is to immediately leave the state, is illegal.

I've also been warned about those states and MD regarding through transit under FOPA when driving. Through, from one end to the other, fine. Don't think about staying overnight. Don't sight see. Stopping for gas or lunch, probably ok but you could end up arguing with a prosecutor. Illinois could be a similar problem in some circumstances, as I suspect could be a few other states.

Nope. Completely legal and the only way to fly with a firearm. I regularly fly out of EWR to three states where I am legal to possess and all that matters is I have my paperwork in order, follow the rules and know the laws of my departure location and destination and obey them..

I keep those State statutes in my phone and have had the need to correct a few misguided TSA idiots at Newark. Believe it or not, the few times I've asked to have NJSP interact due to TSA or airline counter employees, they've been excellent in articulating what IS "legal" to the dolts in the airport.

I could be wrong, but by chance are you a NJ resident with a FID? If so it doesn’t necessarily apply to the rest of us.

And you make a good point about knowing the laws at your destination and anywhere you might layover and be stuck with a canceled connection.

Thing is, he thought that having a license in his state was reciprocal in NYC which it is not. NYC is very restrictive in firearms.

He didn’t violate law. The firearm was in transit and properly secured. NY just wants their taxpayers to keep shelling dough for their idiots infringements...
