A federal judge in Greenbelt, Maryland, on Thursday ordered Salvadoran migrant Kilmar Abrego Garcia released from ICE custody, capping — for now – an extraordinary, 10-month legal fight that has spanned two continents, multiple federal courts, and prompted dozens of hearings in the aftermath of his removal.
U.S. District Judge Paula Xinis ordered Abrego Garcia released from the ICE Moshannon Valley Processing Center in Philipsburg, Pa., ruling that the Trump administration had not obtained the final notice of removal order needed to remove him to a third country.
"Since Abrego Garcia’s return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Xinis said in an order Thursday. "For this reason, the Court will GRANT Abrego Garcia’s Petition for immediate release from ICE custody."
The order comes after Xinis last month used an evidentiary hearing to press the government on whether it had the final order needed to deport Abrego Garcia from the U.S. to a third country, including the list of African nations previously identified by Trump officials.
Justice Department lawyer Drew Ensign previously suggested that the immigration judge who ruled in 2019 that Abrego Garcia could not be removed back to his home country of El Salvador had "meant," or implied a final order of removal — a notion Xinis dismissed in her ruling Thursday.
"No such order of removal exists for Abrego Garcia," she said.
The Justice Department is almost certain to appeal her order to a higher court, as Ensign indicated to her in previous hearings.

Yeah. Like Venezuela, China, Cuba, Serbia, and Iran. Cartel del Sol is the mob arm of the Venezuelan government. It controls all the other cartels and their affiliated “gangs”. The Venezuelan government took the worst people from their prisons, trained them, and sent them into the US to wreak havoc. Gary Berntsen and his Venezuelan research partner have flipped close to 20 engineers who used the Smartmatic software inserted into Dominion to control all US federal elections (President, House, Senate) since 2007. These engineers can tell exactly how they did it. Once the software was able to steal the 2006 Hugo Chavez referendum to keep him in power, China, Cuba, Serbia (using Huawei in Belgrade), and Iran joined the coup attempt. So the people who want Abrego Garcia to be the spearhead for keeping Trump from using the Alien Enemies Act to get rid of these combatants that were sent into the US have a lot of money to bribe US officials with. The whistleblowers who knew about the election corruption also knew about the bribes and the Venezuelan government training people (which the media calls “gangs”) to be sent into the US to destabilize us. USAID and the CIA were involved with all this stuff too, and a witness saw Cartel del Sol hand the founder of BLM $20 million, to destabilize/agitate in the US.
Berntsen has given slam-dunk prosecution evidence to the DOJ and they will soon be making arrests of those who were bribed. I’m thinking it may be imminent because Emerald Robinson got the go-ahead to expose what she’s been kept in the loop about regarding all this, Ralph Pezzullo’s book “Stolen Elections” is out detailing Berntsen’s research, and Berntsen and Pezzullo have done interviews about their findings.

I suspect that Xinis may face indictment soon, as may Boasberg - for being bribed by Cartel del Sol. As Obama’s DEA guy was just indicted for conspiring to launder a bunch of money for the cartels. I also expect Jena Griswold and all the others who have wrongly persecuted Tina Peters in CO for the crime of catching them red-handed trying to destroy the Dominion records that show where the fake election results from Belgrade were inserted into the CO system.
Note that Trump has re-truthed some of these links and has come out vocally against what was done to Tina Peters. I’m hoping that the indictments of these people can be done in time to save Tina Peters, who is a patriot among patriots.

Grok clarifies: "The Supreme Court did rule on Kilmar Abrego Garcia's case earlier this year, but it was a narrow decision focused on his initial wrongful deportation to El Salvador in March 2025—and it actually supported the lower court's order to bring him back to the U.S. That ruling doesn't conflict with the recent federal district court order for his release from ICE custody.
So the utterly ridiculous judicial comedy show continues.
Because a lot of their campaign money originates with gangs like MS-13.

Okay, release him from ICE custody at a few thousand feet in the center of the Atlantic. Problem solved.

This was the fault of Pam Bondi, she should have left his sorry ass in El Salvador, seriously what was the freakin purpose of bringing him back..to do what, file charges against him, she knew, she knew some commie judge somewhere would demand his release, she knew that, she should have left him in El Salvador
