Michael Virgil, 35, and his family boarded Royal Caribbean’s Navigator of the Seas in Los Angeles on Dec. 13, 2024, for a four-day cruise to Ensenada, Mexico, a trip they intended to be a fun vacation.
What began as a routine departure quickly unraveled, the lawsuit says, after an onboard incident involving security that would later become the center of a legal battle.
The family – which includes Virgil’s longtime fiancée and their young son who has autism – has filed a wrongful death complaint in the U.S. District Court for the Southern District of Florida.
Security and crew members allegedly tackled and restrained Virgil, compressing his body until he stopped moving. The complaint says that at the direction of the staff captain, the crew injected him with the sedative Haloperidol and used three cans of pepper spray.

That’s what happens when you buy the “all you can drink package” and you are determined to get your money’s worth.
It was Mr. Virgil’s decision to get hella-drunk.
The cruise line is not known as a babysitter service for paying adults. He may have gone to several different bartenders to collectively drink that many times.
Even watered down alcohol will effect you in great quantities.
Need a little history on the guy. Relatives will lie their a**** off for a nice big payoff.
Three cans of pepper spray? Sounds excessive. But then so does 33 drinks of any kind.

Everything you purchase goes on your ship board card and you pay at the end of the cruise......they should have been able to see how many drinks he had, right down to time served......I’m glad we did all our cruising in the early 2000s before they turned into a floating circus.
So this really isn't about him dying because the ship's bar served him 33 drinks. Its about whether security used excessive force when he got drunk and combative. Maybe they did; maybe they didn't. But this is a lesson about the risks that you take when you get extremely drunk (or high on drugs, for that matter).
Okay,first strike is he did not marry the mother of his child and secondly,he’s a fat slob and thirdly,alcohol is a depressant not a stimulant...what drugs was he taking?

Did an Alaska cruise last August and got the drink package. Yea they lost money. This guy sounds like a lightweight or as I expect, probably brought some of his illegal pharma and mix it with the booze.

Since when are cruise ship staff (or anyone for that matter) authorized to administer an injection without consent?
He was a big fat fella and he was in a drunken rage threatening crew and passengers. Video of him in hallway going nuts on YouTube.
He had one of those drink all ya want packages and drank like a fish before the boat even left port. Supposedly he went kooky and died about an hour after the boat left port.
Family claims it was the dope the medics on board sedated him with that killed him. May have contributed? maybe
I suppose it is a good argument, but 33 drinks in a matter of a few hours could kill you with alcohol poisoning.
Outcome in the legal sense remains to be seen.

Royal Caribbean is going to be sued to the teeth over this.
I imagine the drink packages will come with limits after this. All it takes is one person to ruin it for others.
Are there not cameras all over these cruise ships?
So that they have a record of video proof when someone does something stupid. Like stand on their balcony railing and fall into the ocean.
OR drink 33 drinks and get in a fight with security.

He had a BMI of 49 which equates to Obesity level 3 the highest category.
His blood alcohol level was not quite as high as I would have expected from 33 drinks (0.182-0.186) probably because he was so big and they do water down the drinks on cruise ships.
Sorry, but I side with the cruise line on this one. If a family member has an issue where he is not responsible for his own actions, then a responsible adult should be with him. The fact that he consumed 33 drinks suggests somebody was not watching him or what he was doing. This reminds me of the 18 month old who fell three stories off a balcony, a person on the street sees this and catches the child, saving it’s life, but still sustained a broken arm during the catch. The parents sued to man who caught the baby for medical bills to set the arm plus damages for “stress”. Fortunately, the judge saw through the ruse and not only dismissed the case, but award the man attorney and court cost PLUS $30,000 in “personal damages”. We need more common sense judges like this.

I suspect he had some other drug in his system other than alcohol.

In international waters, the Captain’s consent is all that is required.
The cruise line will settle out of court to stay off the news. But they were wholly justified in their actions.
People successfully sue bars in the US all the time for being overserved and going out and doing stupid stuff.
