There have been too many abuses of the $10K maximum cash on hand statute. Someone who is innocent has to hire attorneys and lose time in court to fight the seizures. Has this law stopped any drug trafficking? Based on the levels of drug abuse, the answer is no despite decades of this law in place. At best, this law catches the foot soldiers; the kingpins remain untouched. They are often paying off politicians, e.g., in Arizona, which has been controlled by organized crime for decades, first by the Mafia and now by the Mexican cartels.

If you really want to stem the flow of drugs, you must go after the top echelon. As the U.S. Attorney, Giuliani did that in New York in the 1980s and greatly weakened the Five Families. However, too many politicians of both parties are compromised by money and other favors.

If they declare it then all is good. They ask them questions when they arrive. So, that means they lied whaen asked the question directly.

The reason it is there is to stop money laundering of drug trafficers.

Since laws like this are the result of legisslation that is passed by Congress, shouldn't Massie point the finger at himself & his fellow members of Congress?

Perhaps he can start a campaign in Congress to repeal forfeiture laws. Because they really are laws that reverse the innocent until proven guilty, into guilty until you prove your innocence, and they are prohinited from using that money seized to mount a defense.

But again, the border patrol are only following the laws Congress enacted

Furthermore, if they can prove that the money came from a legitimate source, they can recover it. But the thing to do is declare it by filing a Report of International Transportation of Currency or Monetary Instruments (FinCEN Form 105).

If unable to declare it legally on the forms, then your next best option becomes to declare it at the border when they ask you if you are bringing in more than 10K. There is a process for forfeiture, and if you are able to prove that this money was obtained legally, then the money will be returned to you.

I live off I-10 in Central Texas. There have been many cases of cars being stopped with cash and having it confiscated. Asians seem to be a target.
The thing is many of them have money pooled from family members, and don’t have receipts for every last dime. They may not be involved in criminal activity, but don’t trust government.
When I was in BiH during the war, my friend’s brother had almost $500,000 in his basement. He made a wise choice as the UN OSCE closed/confiscated the banks in that Canton for an “audit”. Predicted time of audit was 7 years. This was not just money from sketchy individuals. It was money for civil authorities. Policeman’s salaries, teacher’s salaries, pensions, hospitals, etc.
