Dealership Repossesses Customer’s Car, She Responds By Taking Their Name

An Ohio woman who had her car repossessed by the dealership last year even though she was approved for a loan found an unusual means of responding:

McCreary discovered that the registration of the name "Taylor Kia of Lima" had been canceled by the Ohio Secretary of State’s Office after Taylor Cadillac failed to submit a renewal application, according to court documents.

So, she registered Taylor Kia of Lima in her own name.

How much does it cost to change ALL the signage, websites, paperwork...

Like the salesman's card with multiple names crossed out and penciled in.

This may be a scuzzy dealer who hands out the car keys, then calls back later to change the loan terms.

If the dealership was smart they would cut a sweetheart deal on the car with her right now and walk away. But they’re not.
There’s no reason that it took a month to get loan information on her. I get that stuff done on less than 5 minutes all the time. Sounds like a set up. But they got a live one this time haha

I’d be surprised if she wins. Start with “Kia” being in there - I’m sure she doesn’t have permissions to use that name and I’m sure it’s trademarked. Her registration will be cancelled and the legitimate business will then register it.

She had the preliminary/tentative approval for the loan, but then the finance company didn’t actually approve it.

The problem wasn’t her missing payments - she was notified within a month, so it’s likely the first payment wasn’t even due yet. The problem was there was no loan so the dealer never got paid for the car.

The article doesn’t mention what steps (if any) the dealer took before showing up with a tow truck to repossess.

My read is that they said, Your loan is preapproved here is the keys. We will call when the paperwork is ready...
But for some reason, there is always some problem that requires changing the terms of the loan, so they can squeeze a bit more...

We bought a slightly used dealer demo Ford Expedition and wrote a check for the full amount.

A few weeks later and a couple thousand miles from home, we get a call, they were very polite, BUT very concerned.

A problem with the check, the account was valid with sufficient funds, but out of date!

I seldom write checks; my wife manages our finances. I was carrying an old checkbook.

They were very happy to work it out, and nice about it.

There were several businesses locally which didn’t renew their DBA. Some guys went to the county and registered the names for like $10., then demanded money to relinquish the name or require cessation of the name use. All but one caved and paid the money.

Yes, could be?

I was a partner in a motorcycle franchise, and the state of Illinois had more BS rules and inspectors with a hand out, than I thought possible.

Much may depend on the dealer’s relationship to the inspectors and how much they want from the dealer.

Some are, and there are many good dealers.

See #12, I do most of my horse trading second-hand and have had ZERO interactions with dealers that I believe have screwed me or my family.
And I have no problem with walking out on a deal I did not like, and have more than once.

Do you expect them to sell at a loss? On every sale?

Kia has a history of being low brow and catering to the lower end of the financial market. I was a lender for a local credit union (many years ago)and someone came in to get a loan for close to double the MSRP of the car. They were so upside down on their trade that the dealer rolled into the new deal plus every add on etc.

We normally did not value new cars and wrote loans for them if t(e person qualified but there was no way I was putting my name on that loan.

It’s not a matter of that. It was there in her paperwork. The loan approval was conditional. She ended up not qualifying and refused to return the car, so they repossessed it.

Being a psycho, she went off with all these antics. She’s just an ahole

I don’t know who’s paying her legal bills but it seems it would cost more than the car pretty soon. Same thing for the dealer. Might as well give her the car and stop the legal bills and collections efforts.
