Burger King must face a lawsuit claiming it misleads customers with advertisements that make its Whopper sandwich and other products appear larger than they are.
In a decision on Monday, U.S. District Judge Roy Altman in Miami found it plausible that "some" reasonable consumers in the proposed class action could be deceived by Burger King's ads.
Nineteen customers from 13 states accused Burger King of materially overstating the size of nearly all menu items in its in-store and online ads.
They cited its alleged portrayal of burgers that "overflow" the buns, with the Whopper appearing 35% larger than the actual burger and containing more than double the meat.
Burger King acknowledged that its photographers "styled sandwiches more beautifully" than workers do in restaurants, but said reasonable consumers know the point of menu board photos is to make items appear as appetizing as possible.
Altman nonetheless found allegations that Burger King's ads "go beyond mere exaggeration or puffery."
He distinguished the case from a similar lawsuit against McDonald's and Wendy's that a Brooklyn, New York, federal judge dismissed in September 2023.
Altman said Burger King allegedly overstated the size of its products "to a much greater degree," including in post-2017 ads where the Whopper appeared larger than in earlier ads.
Burger King is a unit of Toronto-based Restaurant Brands International, whose brands also include Tim Hortons, Popeyes and Firehouse Subs.
"The plaintiffs' claims are false," Burger King said in a statement on Tuesday. "The flame-grilled beef patties portrayed in our advertising are the same patties used in the millions of burgers we serve to guests across the U.S."

Are Fruit Loops queer?
Asking for a FRiend....
It’s anti-semitism.

Totally Thanks!
RE: As Fruit Loops are not made of fruit...
That’s Froot Loops, brother. Froot.
“The cereal Froot Loops was originally called “Fruit Loops” when it was introduced in 1959. While there is a widely circulated story about a lawsuit claiming the name was misleading because the cereal contained no real fruit, this story and the lawsuit, “Paxton vs. Kellogg’s,” are not supported by evidence. The name was later changed to “Froot Loops,” with the double “o” representing the cereal’s circular shape.”
Controversy includes possible “Mandela Effect” —

Babylon Bee took a potshot at Chipotle a few days ago.
I honestly never tried them.
As a child I had a plastic cereal bowl shaped like a cowboy hat and a glass shaped like a boot. For Wheaties, Sugar Smacks, Kix or shredded wheat.
I consider that the best anecdotal story of the day.
Drama, conflict, characterization and gender highlight.
Plus a story wrap up similar to a good poem’s ending.
John Wayne would be proud...
I used to raid the Frat House individual breakfast serving larder between meals to provide calories as required.
[Not unlike my 4 yr. old grandson requiring ~4 eggs for breakfast over time.]

Ha! In high school had a girlfriend that worked at KFC. Would go thru the drive-thru and order 2-piece, she’d pile 8-10 pieces into the box, then at the window I’d hand her a dollar and she’d give me back a dollar in change. Life was simpler...
I thought it was general knowledge that none of the food in any of these fast food chains looks like the pictures. I never considered suing them over it, though.
“”Maybe the ad bun sizes are underrepresented?””
Don’t know about that but if they have to cut down on expenses, hope they take it from their advertising...they must run more than 100 commercials a day and probably more - YOU RULE!!!
More bs.
Whatever happened to Caveat emptor?!
Bring back the I like square butts add!
Still makes me laugh every time I see it.
The Burger King in Rio Rancho in River’s Edge was known for extremely slow service. They would take up to 30 minutes to fill an order, even if the place was empty. We only went there a couple times, and it’s been almost 30 years since I’ve been to any Burger King.
I worked at both McDonalds and BK in my youth. The lack of cleanliness at BK scared me. Mickey D’s emphasized keeping things clean. Not so much BK.
Additionally, it has always ticked me off that the Whopper doesn’t come with cheese. You can request it, but it costs more.
