You’d think, but Texas is turning more blue by the month. All the critters from California brought their warped senses of reality with them. He’ll be tried as an adult, but I’d guess the death penalty will be removed. The murderers parents need to be horse whipped though.
The murder helped himself to a seat under the victim’s team tent. No one knew the kid, so the victim told him to shag ass. The murderer balked, so the victim grabbed the murder’s back pack and was shuffling him out when the Murder pulled a blade and stabbed the victim. Victim died in his twin brother’s arms.

I've seen reports that is what the dad is saying, that the victim started it. I don't know anything about Texas murder laws, but common sense would suggest you can't knife someone for getting into a shoving match. My guess is capital murder is out the question. That is life without parole or death. I think they charged him with murder, but I could see them dropping the charges to manslaughter if facts of the case warrant it.
Doubt it. No way the murderer could feel like his life was in danger by being told to get up and move. More reports coming out saying some of the kids thought he was in the tent to steal back packs.
it was more than being told to move. The guy put his hands on stabber FIRST.
This is a question of was too much force used when the perp was defending himself from a star football player attacking him.

A kid is dead from another kid who should have not brought a weapon to a school event in the first place, riddle me that one.
You best be prepared that I am right. A self defense claim will be made. Whether it wins depends on facts and jury and Texas law.
The fact is the football star made a threat and followed through with it .
Btw, Texas does not have a duty to retreat law which favors the stabber.

Yes, Texas has a law on knives and restrictions about them . If it is over 5.5 it brings a set of laws . however, I don’t believe that is enough to entirely throw out his defense nor is sitting under someone else’s tent
Metcalf didn’t have the right to put his hands on the kids body to throw him out unless there was more than just a kid sitting under a tent.
This whole thing is going to depend on jurors.
