Judge picks contractor to demolish mistakenly built HPP house

A contractor has been chosen to demolish a house built on the wrong lot in Hawaiian Paradise Park.

Kona Circuit Judge Kimberly Tsuchiya has selected the proposal by Sanborn General Contracting Inc. of Hilo to remove the house mistakenly built on a lot owned by Annaleine “Anne” Reynolds.

The proposed, all-inclusive budget submitted by Sanborn is $121,690.28. The contractor who erroneously built the house on Reynolds’ lot, Patrick John Lawrence Jr. — doing business as PJ’s Construction — was ordered by the judge to deposit the funds for the demolition and removal of debris by Jan. 21, 2025 into an account established by the court.

PJ’s — which was contracted by the developer, Keaau Development Partnership LLC, to build the house on a lot adjacent to Reynolds’ on 8th Avenue — is free to seek reimbursement from KDP through the court.

KDP sued PJ’s and Reynolds after learning the house had been built on Reynolds’ lot rather than the adjacent lot owned by KDP. The civil litigation came after Reynolds rejected KDP’s offer of the adjacent lot in a proposed land swap and made a counter-offer the developer found unacceptable.

Both KDP and PJ’s testified during a three-day hearing in April before since-retired Third Circuit Chief Judge Robert Kim that no survey of the land was done prior to the construction of the three-bedroom house.

Kim granted Reynolds’ motion for a preliminary injunction and temporary restraining order on June 24, ruling Reynolds is likely to prevail at trial “on the merits as she is an innocent victim in this case.”

Kim denied Reynolds’ request seeking to restore her one-acre lot — which she purchased in 2018 for $22,000 at a county tax auction — to its original, predevelopment condition, deeming it “impossible to return the property to its original state.”

Seems to me, the builder should have done survey before they built. They didnt, now all that money is forfeit because they failed to do due diligence. Seems like the builder is trying to pull some sort adverse possession on a greatly accelerated scale.

Agree 100%. One of the worst things we ever did was to overthrow the Hawaiian Monarchy. It should at least be a Commonwealth, like Puerto Rico, if not Independent.

We could always have arranged to keep our bases there, much as in The Philippines.

I agree. It doesn’t make sense. Hawaii is run by the Japanese old ladies like Mazie Hirono who loves to ask people if they have ever made and “unwanted sexual advance” toward little Japanese old ladies up on Capistol Hill.

Other than Ms. Reynolds, the courts appear to the only ones acting reasonably. Ms. Reynolds made a counter-offer which the builder refused. (It might have been to surrender the building to her, as built.) So the builder can either abandon the building, or pay to remove it. Your choice.

Hawaii sued to become a state in the wake of World War II. After seeing how badly the Japanese treated the Polynesians in the islands they overran, the Hawaiians wanted closer ties to the U.S. The terms of the referendum were that it would take a 90% plurality and statehood was irrevocable without the consent of the U.S. Government, meaning the Congress.

Me too and also any outfit that loans money. Given no survey, then the only conclusion that I can draw is that the idiot who had the home built on the wrong lot paid cash for it...so no big loss to him.

Guaranteed every official who saw the plans signed off on it. If you are really really stupid in Hawaii you get a job in government.

The Philippines were never in play. Hawaii had become quite Americanized by 1940 and English was the primary language. And like you said, it would have had too much effect on domestic politics to swallow.

Surveyor’s often get it wrong too, by identifying the wrong lot. One of the biggest risks in the surveying world.

I have property in that area. First time I went over there I walked into the HPP office and asked how to find it. They told me how many telephone poles it was down 19th ST. Gotta count the poles! lol

Restoring the monarchy would be the siren call all the leftists and native Hawaiians could get behind. Elected democrats(+unelected) would have a cow fighting it on 2 fronts. A 99 year ‘lease’ where all buildings would be turned over as the home owning haloes pass on would be justice. The Lahaina fires could be used for a George Floyd response with no need for violence.
