Federal judge rules Trump must reinstate many fired federal employees
The Hill ^ | 3/13/2025 | Schonfeld

“The words that I give you today should not be taken as some kind of wild and crazy judge in San Francisco has said that the administration cannot engage in a reduction in force. I’m not saying that at all,” Alsup noted as he issued his ruling. “Of course, if he does, it has to comply with the statutory requirements: the Reduction In Force act, the Civil Service Act, the Constitution, maybe other statutes,” the judge continued. “But it can be done.”

You can terminate probationary employees without cause.

I think the judge is wrong....downsizing does not require a reason to let people go...

We'll see...

😁 What a great idea!

A car repair illustration of the difference between Liberal approach to problem solving and Conservative approach:

Conservative: Brakes don’t work... replace the brakes

Libera: Brakes dont’t work...fix the horn

Patel is calling on Bondi to take action against Merchan and his daughter.

Bondi should immediately do it. Let’s see if she is all hat and no cattle.

My personal belief is Bondi can’t be trusted either due to incompetence (seen in the Epstein debacle) or Bush connections.

I checked that pesky constitution thingie and the power to fire people that work for the executive branch is granted to the executive branch.
I did not see where the judiciary is granted the power to regulate anything...

“The judges need to be susceptible to sanctions after they are struck down.”

Judges need to face consequences for their partisan decisions. Any judge overturned by SCOTUS should be removed from office. Make the court room a cage contest. Life or death.

Re: "I sometimes wonder if anyone in Trump world expected to win."

In 2024, I predicted exactly what has happened in 2025.

Lots of Right Wing political and judicial theater.

Followed by dozens of Temporary Restraining Orders.

Trump sends Hard Left, career government, lawyers into court to argue the Conservative Case.

The career government lawyers lose or indefinitely postpone every case.

Trump and Free Republic Trump acolytes explain that Trump is completely helpless against a corrupt judiciary.

My prediction for January 2027, after the 2026 Mid-Term Election...

Trump will issue a "Really Tough Path To Citizenship" executive order for the millions and millions of illegal immigrants who are still living in the USA.

FR Trump acolytes will explain this is the only possible solution to a completely impossible situation.

I agree with this judge. Trump FIRED everyone for made up performance reasons. He didn’t lay anyone off. If you read closely, the Judge said Trump must abide by the clear reading of the law when laying people off. RIFs are a proper process with bump and retreat rights offered to the employees. What Trump did was illegally fire everyone, and prevented them from getting unemployment insurance because he said it was across the board for “performance.” Not only did Trump fire new employees, but he fired all recently PROMOTED employees (because when you are promoted, you start a new probationary term). He took a hatchet to the federal workforce which is specifically against the law. Trump just needs to do things by the book, that’s all.

A couple quotes from the judge...

“It’s a sad day when our government would fire an employee when they say it was based on performance when they know good and well that’s a lie”

“That should not have been done in our country. It was a sham [in order to avoid ]statutory requirements.”

The judge did not say Trump could not do a RIF.

To dig abound in the weeds of reality, the workers were Riff’ed

There was a Reduction in Force. There was actually no firing except in very specific instances.

The problem with your analysis is that the proper forum for such disputes is the Merit Systems Protection Board.

The reason it was created was to keep such disputes over federal personnel policy out of the courts.

https://www.mspb.gov/

It has resolved many thousands of such disputes over decades.

The leftists decided to skip over proper administrative procedure—and they found a judge who was good with that.

This is why the case is stupid and will fail.

Here is an article from the Los Angeles Times that explains the process:

https://www.latimes.com/politics/story/2025-03-13/legal-rights-federal-employees-complaints

Key quotes:

“Four federal judges in recent weeks have tossed out large lawsuits brought by unions and others representing federal employees, saying the courts lack power to block layoffs”

“The Civil Service Reform Act of 1978 created an administrative agency inside the government to hear complaints from federal workers who say they have been wrongly demoted or discharged. And the Supreme Court said this agency provides the “exclusive forum” to decide those claims, not an independent federal court.”

“Citing that procedural rule, four federal judges in recent weeks have tossed out large lawsuits brought by unions and others representing employees.
Judges voiced regret but said they “lacked subject matter jurisdiction” to hear the complaints or to rule on the legality of the firings.”

“But judges are “duty-bound to decide legal issues based on even-handed application of law and precedent — no matter the identity of the litigants”

This one wackadoodle judge ignored decades of precedent and four other judge’s rulings in the past month.

This judge has committed gross judicial misconduct.

You have zero knowledge of what the MAGA team of thousands of professionals/lawyers and executives put together to DO— and how to do it.

It was NOT “made up as they go along” as you seem to opine. Read, learn and you will see, that all of these “orders” have no, NONE, zero Constitutional authority to be made by any slack jawed political appointee judge to make from anywhere in the country. The various entities will be instructed and have been... to ignore ILLEGAL orders. Another part of the Executive Branch’s power invested in the Chief Executive.
And even the recent SCOTUS ruling... delayed any stupid judges whim to “rule from the bench”.

Next up, those persisting will be fired from the Judiciary- which is another part of the Executive Branch. The Chief law enforcement officer of the USA is the President of the USA, and has the power to do this, and always has. Fire Prosecutors, judges who think they can run an Executive agency— and all others in that system not following their proper office.

Yeah,—— good one “Fredo”.... as in “I’m schmart....” from The Godfather.

Figuratively speaking every one of these judges should be worried about any boat trips they are taken on. The US Marshals can arrest ANY federal judge. Most do not know that.
And that would really put some saltpeter in the demonrats gruel.

Good one cgbg!

Lol.

Sometimes I feel like Michael in Godfather II trying to explain his latest Family strategy to Fredo.

The most creative and complex strategies mean nothing to those who cannot even begin to understand them.

The layoffs of probationary employees was off the charts brilliant—probably took months of legal research to figure out the best way to do it.

Each individual fired employee can appeal their firing to the Merit Board—one at a time. If hundreds of them do it the Board will be tied up in knots for years—and the vast majority of the appeals will ultimately fail.

The Fredos of this world cannot comprehend what the administration is doing and why they are doing it.

What President Trump and his team have done is make the arcane federal bureaucratic procedures work for him and us instead of against us.

It is stunningly brilliant—and I salute them.

STOP APPOINTING FEDERAL JUDGES and there wont be time for more lawsuits to be considered. Clog the system.

Perhaps our worthless congress could do something productive for a change

Not going to happen. There continues to be no Republicans in Kongress. They are merely the Repugnant Party. These whores go into office because by doing so they can go from flat broke to multimillionaires in just a few short years.

But if any of them buck the system (by trying to do the right thing), they get frozen out and can't get rich. They're there for the money, not for the service.
