NBC settles defamation lawsuit with doctor falsely labeled "uterus collector"

NBC had argued that its segments focused on the accusations that Amin had performed "unnecessary and unconsented-to medical procedures on detainees at ICDC, including large numbers of hysterectomies," according to the legal filings.

Judge Wood said the actual focus was on "mass hysterectomies," citing the amount of time spent on the question, and the network's headlines, including "WHISTLEBLOWER: HIGH NUMBER OF HYSTERECTOMIES AT ICE DETENTION CTR." and "COMPLAINT: MASS HYSTERECTOMIES PERFORMED ON WOMEN AT ICE FACILITY."

Amin received death threats and bomb threats, lost patients, lost the ability to provide medical service to the ICE facility as a result of MSNBC's broadcasts, his lawyers say. They also say he's withdrawn from social and community activities he previously enjoyed.

Dr. Amin has MSNBC dead to rights, that's why they're settling. The NPR article doesn't mention (surprise surprise) the juiciest stuff- MSNBC's internal communications over the matter, which were revealed during discovery.

Maddow, Chris Hayes, and their producers, behind the scenes, all had serious reservations about the story, but decided to run with it anyway. After it ran on multiple shows, MSNBC's standards/legal department intervened and pointed out that there was zero supporting evidence, and all they could find was mention of 2 hysterectomies- one of which they couldn't even verify occurred, the other was medically valid. And then Hayes and Maddow doubled down and ran follow up stories presenting the claims as corroborated anyway. The judge ruled all of the above as undisputed fact last year.

So yeah, Dr. Amin's lawyer already demonstrated that MSNBC as an organization knew better and acted with actual malice.

I wouldn't be shocked if they're settling for more than the $30 million he sued for- no chance in hell they win in court, and when even the judge is saying actual malice is coming into play, punitive damages start looming pretty tall...
