The U.S. Court of Appeals for the Ninth Circuit has rejected an attempt by President Donald Trump to reinstate his executive order aimed at curbing birthright citizenship. The court's decision on Wednesday (February 19) leaves in place a nationwide injunction that blocks the order, which was signed on the day of Trump's inauguration. The order sought to deny birthright citizenship to children of undocumented immigrants and certain foreigners by reinterpreting the 14th Amendment.
The Ninth Circuit's three-judge panel unanimously ruled against the Trump administration's emergency request to lift the injunction, stating that the administration did not make a strong case for success on appeal. Judges William C. Canby Jr. and Milan D. Smith Jr. noted that the administration failed to demonstrate that the injunction was overly broad. Judge Danielle Forrest, in a concurring opinion, emphasized that emergency relief should be rare and that the case did not meet the necessary criteria.
The lawsuit challenging the order was filed by four Democratic-led states, including Washington, Oregon, Arizona, and Illinois. These states argue that birthright citizenship is guaranteed by the 14th Amendment, which grants citizenship to all individuals born on U.S. soil. The Ninth Circuit's decision is the first appellate ruling on the matter, and the case may now proceed to the Supreme Court.
The Trump administration has faced multiple legal challenges to the order, with district courts in Massachusetts, New Hampshire, and Maryland also blocking its implementation. The Department of Justice has characterized the order as part of Trump's broader effort to address immigration issues and national security concerns at the southern border.
How can we get by the tyranny of the judicial (I ask again)?
Knowing all along that this was headed to SCOTUS, having the 9th Circus disagree is the best possible outcome.
We have to take the House and Senate in 2026 by unstoppable margins and pass a statute defining birthright citizenship while removing interpretation of said statute from judicial review.
Congress just has to define “subject to the jurisdiction thereof” and that would be that....
And on to SCOTUS and let’s hope it’s the Supreme Court of the US and not the Supreme Clowns of the US

This whole deal over birthright citizens was wrong. The stinking amendment was because freed slaves were not being granted citizenship. The amendment allowed that. The supreme court ruling decades ago on this was wrong. It can be corrected now if the conservatives in the court get off their collective butts (I’M not worried about Justice Thomas, that guy is a rock) and stick together. Roberts has to man up. Yeah, I know that that means, he ain’t no man.
It seems only fair that the judges on the 9th Circuit Court should pick up all of the expenses too.
Undocumented immigrants, defined as “illegal aliens” in the U.S. Code, don’t meet the requirement of being subject to the jurisdiction of the United States since they’re citizens of a different country.
The 14th Amendment does not confer automatic citizenship.

No, the Supreme Court did that all by themselves, so what? Despite what we might want they will re-decide this because there is zero chance we could mount a Constitutional amendment to fix it.
This needs to be settled by the SCOTUS.
The courts have always assumed, after US vs Wong Arc, that birthright citizenship is a must. The decision there is fairly broad in favor of that, but the situation was different in that the person was already part of society and working in the US. His parents didn’t come here to give birth for citizenship illegally, they were here legally.
Let the SCOTUS make the decision. The order may or may not survive a SCOTUS review, but it’s not a rush to do so. I don’t think it’s tyrannical of the judicial system to hold up the Executive Order and kick it up to SCOTUS.
Do not be surprised if this does not languish in the courts for 4 years before ever having a shot at getting to the Supreme Court.
