A white woman who gave birth to a black baby through IVF and lost custody of the boy is now suing the fertility clinic she went through to have the procedure.
Krystena Murray, 38, filed a lawsuit Tuesday against Coastal Fertility Specialists in Savannah, Georgia, a little over a year after she gave birth in December 2023.
Since she chose to have a white sperm donor, she was immediately caught off guard when her baby was dark-skinned.
After taking a DNA test and reaching out to the clinic, she learned that another couple's embryo was mistakenly placed in her uterus, Business Insider reported.
That didn't stop Murray, a single woman, from falling in love with and bonding with her newborn, even though he wasn't genetically hers.
But just five months after giving birth, Murray lost custody of the child to his legal parents - the couple who had provided the embryo to the clinic.
'I've never felt so violated,' Murray said during a press conference with Peiffer Wolf, the personal injury firm representing her.
She added that she felt 'emotionally and physically broken' after having to relinquish her rights to a child who she fully thought was hers until he was born.
Murray said she had wanted a child for a long time. She found a sperm donor who was a white man with blue eyes and dirty blonde hair, physical features she shares.
She said she felt conflicted the moment she delivered the baby boy, knowing he wasn't hers but at the same time bonding with him.
'The birth of my child was supposed to be the happiest moment of my life, and honestly it was,' she told reporters on Tuesday. 'It was also the scariest moment of my life.'

God’s plan for procreation is basic. It takes mankind wanting to play god to complicate the process.
It’s a blind spot spiritually including Christians…Pres Trump just signed an E.O. to make IVF more accessible.
I acknowledge that Trump is not the most religious person nor do I expect him to be a paragon of the faith and doctrine — God is using him mightily regardless - but Christians esp with any degree of scholarly training, owe it to the faithful to open up the can of worms that is IVF. We need a reckoning.

That is really bad.
She and the other couple should sue big time.
No system is fool proof. When thousands of women use IVF at least a few mistakes will be made. I can’t imagine what went through the poor women’s mind, such conflicting emotions. I do think since she said she “bonded” with the baby she should have been able to keep it.
I understand she is continuing to pursue IVF, but at a different clinic. What happened to her first embryo? They said there was a mix up. So where is it?
My first thought, too! Funny how the article totally elides that issue!
Are her frozen ova still suspended in liquid nitrogen somewhere, waiting to be fertilized?
Or did they fertilize her ova, and then freeze the embryos? (It's always more than one.)
Or did they fertilize her ova - possibly also with the wrong sperm - and implant the embryos in some other women already?

A fertilized egg can be frozen for later implantation.
There is a difference between fertilization and conception. Scientists say half of fertilized eggs are lost. Conception happens when the fertilized egg is implanted in the uterus, as in the Biblical language “the woman conceived.”

Many of us do not agree with the definition quoted if the implication is that life begins at some point after fertilization (such as at implantation, etc.). Opinions vary of course but for those trying to understand the primary reason for opposition to IVF, that’s it. That is, more embryos are created than used and of the ones used, many are killed off through “selective reduction”.
According to a different article, the woman who gave birth still doesn’t know what happened to her embryos and has obtained a lawyer. I don’t know if Coastal Fertility isn’t disclosing any information regarding her embryos to her or if Coastal just doesn’t know the status of her embryos.

One issue I'd like to point out - excuse me if you already knew this; I'm addressing the other FReepers out there who might not know - is that the IVF technicians, as a matter of course, always deliberately produce more embryos than they intend to use / implant. Due to the hormonal "fertility treatments." a woman might produce TEN to TWENTY OVA at once. Of the 10-20 resultant embryos, only the "best" 1-2 are then implanted into the woman (the goal is to minimize the risk of multiple pregnancies while maximizing the chances of a successful implantation). The other "sub-optimal" embryos are then discarded.
Yes, that's Eugenics!
Of course, if the woman has checked the corresponding box on the consent form, those supernumerary embryos might be diverted to other purposes - e.g., scientific research, fulfilling the needs of women incapable of producing ova, "helping" gay men, or making novelty paperweights.
