Texas restaurant chain ordered to pay $2.8M to woman burned by BBQ sauce [Jackpot alert]

A Texas jury has ordered a restaurant chain to pay $2.8 million to a woman who filed a lawsuit after she was burned by BBQ sauce.

Genesis Monita, 19, sued Bill Miller Bar-B-Q Enterprises in October 2023 after she had been served sauce that gave her a second-degree burn earlier in the year.

The incident took place in May 2023 when Monita ordered breakfast tacos with barbecue sauce from the restaurant, according to court documents seen by FOX 26 Houston.

After taking the sauce out of the bag, Monita dropped it on her leg because of how hot the container was and sustained a second-degree burn.

The restaurant's policy states that sauce is a minimum of 165 degrees when it's served, according to the lawsuit, and the sauce was reportedly 189 degrees that day.

Monita was awarded $2.8 million total by a jury of six men and six women on Friday.

More than $25,000 was paid to her for medical expenses following her injury and $900,000 was for past and future mental anguish, physical pain and impairment.

The restaurant franchise was found to be "grossly negligent" by the jury, awarding Monita $1.9 million in punitive damages.

Medical expenses are fine. Double for pain and suffering but anything beyond that you will have had to made some major mistakes.

I think this is quite exaggerated. I don’t believe its reasonable damages.

I think that juries which hand out ridiculous awards, should go to prison. They aren't taking their duty seriously, and they need to sit in a prison cell to contemplate what @$$es they were.

I live in Texas mostly (have a place in N. LA). Never had 165° BBQ sauce. Ever.

And how is the restaurant "grossly negligent"?

They had a warning, and could not make her be more careful.

I'm also guessing she sat down before unloading the bag and did it in her lap, instead of getting the meal set up THEN sitting down to it.

Onky second degree burns? I beleive that the woman who sued McDonald’s for her burns had 3rd degree burns and suffered terribly for quite awhile afterwards

How did they know the exact temperature of the sauce?

And is 189 really that hot? For reference, the recommended minimum internal temp for poultry is 165 but lots of people go hotter than that.

Somehow 189 just doesn’t strike me as dangerously outside the norm for cooked food.

5 seconds at 140 deg contact
with the skin can cause 3rd deg
burns.
At 189 deg, I wouldn’t want to
hang on to it for very long.
Investigators probably went straight
to the source for the 189 deg
temp., though I think the sauce at
time of contact could have been
lower.
If the sauce landed in more personal
places, I could see where this would
have long lasting effects.
Not agreeing with the judgement
though, seems a little excessive.
