Elon Musk has called for the impeachment of an Obama-appointed judge who barred DOGE and the Treasury Secretary from accessing payment systems at the US Treasury.

On Friday night, Democrats went ‘judge shopping’ to ask that Musk’s team be stopped from accessing Treasury systems, knowing that instead of receiving a judge by random selection, the only available judge would be Paul Engelmayer – who held an ex-parte hearing without DOJ lawyers. Engelmayer did not cite any case law or precedent for his ruling, which many have criticized for vast overreach.

Judicial nutcases can be mainly neutralized by say allowing the plaintiff to exclude up to 1/10th the judges of a judicial district and the defendant up to 4/10ths.

As for crazy jury awards, each prospective juror might be required to compute damages on paper for say four hypothetical cases, two prepared by the plaintiff and two prepared by the defense. Then 2/10ths of the prospective jurors could be excluded by each side.

Not only that the Judge did an illegal ruling without even hearing anything from the Trump admin

He needs to be impeached because he engaged in a transparently illegal action

Perhaps:

Under the Article I, Section 8 power of Congress to set rules for the government, judicial orders shall not take effect until approved by at least one branch of the legislature wholly liable for funding the court of the judge.

However, a judge or judicial assembly may with immediate validity:
1. properly restore liberty to persons,
2. properly restore property to persons,
3. handle purely private party legal matters,
4. see to it that the Bill of Rights is observed,
5. see to it that Amendment XIV is observed as permitted by Congressional legislation to the extent that the power of a legislature is not in any way usurped,
6. order the payment of legislatively imposed revenue amounts,
7. enjoin the bad behavior of non-public actors as permitted by other law,
8. enforce the criminal laws as expected.

All consent decrees shall require the approval of Congress, which shall last for no more than two years after each such approval.

“The Congress shall have the power to dispose of and made all needful rules and regulations respecting the territory or other property belonging to the United States”

Congress can take half your income via Amendment XVI and toss it into a Waste Management truck, or hand it to the Cadillac-driving sister of the binman.

Choices: (1) Ignore the dictates of these judges - then you will have the democrat media screaming dictatorship.

Outcome Likely Succeeds. [High chances of success]

May unfortunately lead to a real dictatorship. That would eventually need to be scraped off later.

(2) Appeals process - takes a long time.

Outcome Possibly Fails. [Medium chances of success]

Delay is a win for the Democrats that allows them to cover their tracks and obstruct investigations into their crimes. Expect hundreds more of these lawless injunctions if this most recent one is allowed to stand.

The appeals process can only work for us if the first appeal succeeds very quickly and shuts down all further attempts at the rule-by-court order tactic.

Otherwise, it is back to option (1).

(3) Impeach

Outcome Certainly Fails. [Zero chances of success]

Not possible with the present makeup of Congress. Very unlikely to ever get a Congress that will do this in the future. Not relevant if it cannot be done right now.

A low-probability alternative is to arrest the judge and charge him with obstruction of a lawful investigation into criminal activity at the US Treasury. His order to erase all collected data amounts to an order to destroy evidence and is unlawful.

The judge may also have committed other violations of law.

As has been said about the complexity of Federal laws, "Everybody commits three felonies per day".

Or as the Democrats do, "Show me the man and I will show you the crime".

Are you saying we should just give up and let things fly because we don’t have the numbers???

Not saying that at all. Just pointed out 3 possible solutions that I'm aware of under our current Constitution and laws. There may be other solutions that I'm ignorant of.

What do you propose as an antidote to activist judges?

I agree something needs to be done. To remove a judge, it requires 1/2 the House to vote for impeachment and 2/3 the Senate to remove. IMHO - Congress impeachment/removal of these scumbags is unlikely because it will take 2/3 of the Senate to remove them. Unless there's another way, challenging these activist judges in appeals courts may be the only way to beat them.

YES...

I can see it now though, the Republicans will say “but the Dems will impeach our judges when they rule against them.”...

GOOD.

We need to enter a new era where ANY judicial decision that isn’t backed by rock solid legal precedent is met with impeachment. In that world, there will be no judicial activism. If you can’t backup your opinions by clearly established case law, you are out.

This is how the law is supposed to work.
