Idaho murders suspect Bryan Kohberger is expected to return to a courtroom this week ahead of his summer murder trial for the stabbing deaths of four University of Idaho students in November 2022.
A hearing Thursday will consider 12 suppression motions filed by Kohberger’s defense.
It will be the first time Kohberger has been back in court in over two months, when his defense team asked a Boise judge to “sanction” prosecutors over “inadequate disclosures” through the discovery process.
His defense team is requesting expert witnesses be excluded from the case as a solution.
His team is attempting to have nearly all the evidence collected by police against Kohberger thrown out by challenging the legality of search warrants.
They are arguing the probable cause on which the search warrants were based was established primarily by the police use of investigative genetic genealogy (IGG), which they believe amounts to a violation of Kohberger’s Fourth Amendment rights.

They’re doing what defense attorneys do......exhaust all avenues to get the case thrown out before AND during thectrial.......to me defense attorneys can pull some really dirty stuff to get their clients off, but like it or not this here IS what they are getting paid for.
According to the article, the suppression motion is based on the argument that when the police used DNA evidence as probable cause for the warrant(s), they violated the suspect’s 4th Amendment right to be secure from any unreasonable search and seizure. I suppose the question then is does a person have a reasonable expectation that their genetic information, or such DNA they might have left behind in a place outside of their dwelling, will remain private. I think not, and the argument verges on being frivolous.

Agreed but in not arguing this they would be derelict in their representation......any decent lawyer would do the exact same thing.
And if/when this goes to trial one of the first things the defense will do is request the case be thrown out.

already been determined long ago that if you throw something away you lose all rights to it, including DNA on those items.
Worth a shot - especially given that the known evidence looks pretty damning.

Multiple freepers made the same/similar claim when this technique first surfaced a few years ago.
THAT kind of DNA testing is a GAME CHANGER.

Trial date is set for July and his lawyer’s got nothing but heck throw out everything....please!
He lived in Pullman, Washington, a college town, in a Hard Left, No Death Penalty state.
He deliberately crossed the state line to murder four college students in Idaho, a Republican, Death Penalty state.
Most amazing of all, he stole or borrowed a hunting knife and sheath from his father.
Somehow, he left the sheath at the crime scene. The Police found his father's DNA on the sheath.
This is stupid piled on top of even more stupid.
Idaho executes by lethal injection.
If lethal injections are outlawed, the fall back is a firing squad.
I am rooting for the firing squad. I know that has to really hurt for a second or two before you lose consciousness.
I live in Spokane. Went to Moscow, ID a few years ago. Very small for a capitol city, just a nice little town with friendly people. Unimaginable that such horrible murders were committed there.
I vote for a firing squad too. Or better yet, off with his head.

IMO, most of this case is bogus. Those kids were killed by domestic surveillance, why, I have no idea. But too much was hinky there, especially the dude following them the night before saying “They will get you for this Kaylee!”
