Supreme Court leans in favor of state-enforced age limits on porn websites

WASHINGTON  —  Thanks to the internet and smartphones, children today have instant access to vast amounts of online pornography, much of it graphic, violent and degrading, Texas state attorneys told the Supreme Court on Wednesday.

They urged justices to restore the rules of an earlier era, when X-rated theaters and bookstores had an adults-only policy.

Last year, Texas enacted an age-verification law that requires pornographic websites to confirm their users are 18 or older.

Lawyers for 23 other Republican-led states joined in support of Texas, saying they have or plan to adopt similar measures.

The court’s conservative justices signaled they are prepared to uphold these new laws.

They noted that age-verification rules are now common for online gambling and for buying alcohol or tobacco online.

But more importantly, they pointed to the dramatic change in technology and the easy availability of hardcore pornography.

We are “in an entirely different era,” said Chief Justice John G. Roberts Jr. “The technological access to pornography has exploded.”

He said that warrants reconsidering rulings from decades past that invoked the 1st Amendment to strike down anti-pornography measures.

In one such ruling, the court in 2004 said parents and librarians could use filtering software to protect children from pornography.

Justice Amy Coney Barrett said parents have long known that “filtering” software is not effective in protecting children. “Kids can get online porn through gaming systems, tablets, phones and computers,” she said. “I can say from personal experience ... content filtering isn’t working.”

In the past, she said the court had no problem upholding laws that prevent bookstores from selling sexually explicit books or magazine to children or teens.

She questioned why online porn should be treated differently.

Don’t know the details but why can’t these websites host themselves in a different country. I suppose if they are Americans they can be sued, but if they are not Americans, hosted elsewhere — why can’t this evolve to be the majority of pornsites?

But the founders never intended protection from pornography, which was infinitely less available then and massively against the culture of the day.

There never has been and never will be a viable argument demonstrating original intent to protect pornography.

The interpretation of the courts regarding both religion and morality has been awash with careless thinking.

The Declaration of Independence mentions God several times, and the Constitution is based on its principles.

There is no viable Constitutional argument favoring pornography. Not in the letter of the law, nor in the spirit.

The arguments for banning pornography are extremely simple.

They weren’t ignorant of pornography. They were knowledgeable men of the world. They were well aware of naked pictures that passed around in their day, but they still didn’t write against it.

If you got pornography banned, you’d find the Supremes would rule against the Bible as a rule of law. That’s how liberals think. When you ban something, the liberal will take that ban and apply everywhere including the Bible.

Not because I am involved in porn, I do assure you of that. I just know that liberals are waiting for the ban on porn to be considered Constitutional, so they can go after the Bible.

That is what strikes a nerve with me. I don’t know why that doesn’t strike a nerve with you.

No, what you say is incoherent and downright silly.

If it were true, then the ban against yelling fire in a crowded theater would have led to more restrictions. It did not.

FreeRepublic has no pornography.

Should we remove the age restrictions on driving, alcohol use or voting? Leave it to the parents?

1. Pornography breaks up families on a mass scale which equates to the demise of our country.

2. Addiction to pornography eventually induces interest in child porn.

3. Pornography use prior to marriage either sets it up for failure or causes people never to want marriage.

4. The founding fathers did not intend protection of porn which was exponentially less available in their day.

5. One of the most fundamental ways to interpret the Constitution is to have a sense of the concepts of letter of the law and spirit of the law.

On every point, so does the Bible.

I get your opposition to porn and desire to see it gone from society. But you don’t understand, and I guess you’re one of those Christian who think liberals are good people.

If you ban porn, your children and grandchildren will never be able to read the Bible. It will be a banned book under the exact same laws that you want to use to ban pornography.

The Bible will become an illegal book and there won’t be any way to stop that.

The naked pictures in the days of the founders were for not available to most people, first and foremost because of the cultural restrictions, but also because of the state of technology.

Whatever naked pictures they had then were as common as finding an 11-leaf clover.

Pornography these days is as available as the air you breathe.

If pornography is banned, the Bible will triumph and the number of people who read it will increase.

There is lots of pornography in the Bible, as the law would define pornography. You are being completely ignorant about things.

I get it, you want a pure society that is free of filth. So do liberals want their pure society, free of the Bible.

I am right. You are one of those Christians that need to see the Bible banned and people jailed for trying to carry Scriptures before you understand why want you want would result in a ban on the Bible.

The difference is not something you can make up because it’s mathematical.

Pornography was not available to most people in the days when our country was founded.

This state of things only started to slowly crumble after Darwin, Freud and then Hollywood.
