The Manhattan jury deliberating Daniel Penny’s case in the chokehold death of Jordan Neely on a New York City subway last year is deadlocked on the manslaughter charge, according to a note the panel sent to the court Friday. The 12-person jury sent the note marking its impasse after 16 hours of deliberating since they got the case Tuesday afternoon. The judge and the parties are conferring over how to respond.

This is not a great outcome but it is certainly better than a “guilty” verdict on either of the charges presented to the jury.
No wonder they’re so dumb.
The best he can hope for all things considered.
Manslaughter is the top charge, the jury can then deliberate on count two, a lesser charge of criminally negligent homicide which carries a maximum punishment of four years in prison.
At least there was 1, or more, jurors who weren’t railroaded into finding an innocent man guilty. A man who is a hero IMO.

So...hung jury ON THE MOST SERIOUS CHARGE.

Hard to imagine how one is not rising to meet the elements of manslaughter but does meet them for homocide... but weirder things have happened.
Lawyers don’t get to pick juries. They can excuse a small number of potential jurors during Voir Dire, but the jury you get will reflect the population of the area.
In this case, a dysfunctional blue city with a politically motivated DA.
The New York Post published an article three weeks ago saying that Bragg is favored to win reelection in 2025.

They absolutely picked the jury I was on.
The black witnesses to the incident that I saw speak out were all behind Penny and said he did the right thing.

I think at least a few jurors are aware that Penny will not survive prison, and will refuse to convict.
IIRC, lawyers CAN reject SOME jurors. They cannot do so forever. So they can influence what jurors get on, but certainly cannot pick a responsible, conservative-leaning jury in a place like DC or NYC.
Meaning - just don’t get involved.
According to the Fox report, the judge is indicating that if they are deadlocked on the most serious charge, he will have to declare a mistrial on both counts.
I think that’s a good thing.
He deserves the key to the city and a hero’s parade.
Charges need to be dropped.
