Smith had reportedly been working to wind down his cases against Trump — and step down before the former president gets sworn back into office on Jan. 20, 2025, and likely fires him.

Presiding US District Judge Tanya Chutkan previously agreed to put the Jan. 6 case on pause days after the Nov. 5 election in light of Trump’s victory.

After careful consideration, the Department has determined that OLC’s prior opinions concerning the Constitution’s prohibition on federal indictment and prosecution of a sitting President apply to this situation and that as a result this prosecution must be dismissed before the defendant is inaugurated. That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution, which the Government stands fully behind. Based on the Department’s interpretation of the Constitution, the Government moves for dismissal without prejudice of the superseding indictment under Federal Rule of Criminal Procedure 48(a). The Government has conferred with defense counsel, who does not object to this motion.

Note the words "without prejudice" which were preceded by the statement that the government stands fully behind its prior actions and is only moving for dismissal due to the Constitution’s prohibition on federal indictment and prosecution of a sitting President. How convenient - they could very well wait four years and try again if Dems regain power.

He thinks he’ll just wait 4 years and refile. But if he gets investigated and crimes are found he may not be free to do so.

We need an investigation of all these weaponized prosecutions against Trump. Get all of their communications, and all of the communications and meetings between the Biden administration and Fani Willis and Alvin Bragg and all of these other characters involved.

No doubt there will be found corrupt motives and there will be destruction of relevant records by the guilty parties.

Unlike when the Mueller investigators destroyed their phones, people destroying and concealing evidence need to be prosecuted and imprisoned.
