The house-of-cards case against Daniel Penny is falling apart

On Friday, the defense rested in the Daniel Penny trial, leaving many observers to ask what Manhattan District Attorney Alvin Bragg was thinking in pursuing this case.

Over the course of the second-degree manslaughter trial, Bragg’s prosecutors tried to sell the narrative that the Marine vet overreacted and behaved “recklessly” when he restrained Jordan Neely on that F train back in May 2023.

But a host of prosecution witnesses, Penny’s fellow passengers, knocked massive holes in that tale, as one after another veteran subway rider described how terror-stricken they felt while trapped in the train car with the angry, unstable, threatening Neely.

One woman said she “was scared s–tless” by Neely’s behavior and recalled him yelling: “I don’t give a damn. I will kill a motherf—er. I’m ready to die.”

She stuck around after the ordeal to thank Penny for defending her and everyone else in the car that day.

Another, a high school student, said she was “so nervous” that she feared she “was going to pass out,” and said she didn’t hear other passengers’ warning to Penny to let go of Neely during the struggle.

A third said Penny restrained Neely “so he wouldn’t attack anybody” — more proof that Penny was selflessly acting on behalf of others and a direct blow to lefty claims that his actions were racially motivated.

In short, the prosecution case offered up plenty of evidence that Penny acted rationally and bravely in a harrowing situation.

And the defense started off with a bang.

On Thursday, forensic pathologist Dr. Satish Chundru testified that Penny’s chokehold wasn’t what killed Neely, but instead “the combined effects of sickle-cell crisis, the schizophrenia, the struggle and restraint, and the synthetic marijuana.”

Maybe someone will force the DAs to pay for the defense’s expenses if the prosecution’s case is proved to be frivolous or false.

Ordinarily, a good bit of reasonable doubt in court would prompt an acquittal. But in a NY court only a miracle would suffice.

There has to be a way of bringing NYC out of the turd-world. Same with DC. Why are these of all places so decidedly anti-American/turd-world? Not just the politicians but the population from which an honest jury is supposed to come.

Penny has already been punished by being financially ruined. This is one of the left’s favorite tools. In 1985 Mayor Ed Koch dispatched 1,300 extra police to find the gunman in the Goetz shooting. Once Goetz was identified New York District Attorney Robert Morgenthau tried to imprison him twice after the first grand jury threw out the attempted murder charge. Morgenthau never attempted to convict the four robbers. Criminals are the vanguard of the revolution. Mikhail Bakunin said, “The brigand is the true and only revolutionary in Russia.” Fay Stender, the founder of a prison movement, had a strong belief that prisoners were going to be in the vanguard of the social revolution. “There are no criminals, only political prisoners.” These people control a large part of our legal system.

Imho, Daniel Penny is a hero. If the corrupt N.Y. courts find him guilty and sentenced to prison time, I’m hoping Pres. Trump pardons him.
