The house-of-cards case against Daniel Penny is falling apart

On Friday, the defense rested in the Daniel Penny trial, leaving many observers to ask what Manhattan District Attorney Alvin Bragg was thinking in pursuing this case.

Over the course of the second-degree manslaughter trial, Bragg’s prosecutors tried to sell the narrative that the Marine vet overreacted and behaved “recklessly” when he restrained Jordan Neely on that F train back in May 2023.

But a host of prosecution witnesses, Penny’s fellow passengers, knocked massive holes in that tale, as one after another veteran subway rider described how terror-stricken they felt while trapped in the train car with the angry, unstable, threatening Neely.

One woman said she “was scared s–tless” by Neely’s behavior and recalled him yelling: “I don’t give a damn. I will kill a motherf—er. I’m ready to die.”

She stuck around after the ordeal to thank Penny for defending her and everyone else in the car that day.

Another, a high school student, said she was “so nervous” that she feared she “was going to pass out,” and said she didn’t hear other passengers’ warning to Penny to let go of Neely during the struggle.

A third said Penny restrained Neely “so he wouldn’t attack anybody” — more proof that Penny was selflessly acting on behalf of others and a direct blow to lefty claims that his actions were racially motivated.

In short, the prosecution case offered up plenty of evidence that Penny acted rationally and bravely in a harrowing situation.

And the defense started off with a bang.

On Thursday, forensic pathologist Dr. Satish Chundru testified that Penny’s chokehold wasn’t what killed Neely, but instead “the combined effects of sickle-cell crisis, the schizophrenia, the struggle and restraint, and the synthetic marijuana.”

It sure seems like the prosecution is because of the races of the people involved.

It’s a jury trial is it not?

Penny is white, the person that died is black and we’re talking about nyc here......full of libs.

You never know what a jury will do.

I pray not, but I fear this young man may go to prison.

A rational jury would find him not guilty. A honest judge would give a directed verdict of not guilty. This is New York.

Bragg is a racist through and through. He hates white people and believes that the legal system should turn all black criminals loose on the streets.

Whitey deserves what he gets.

If Daniel Perry is convicted, female subway riders in New York City will face increasingly worse attacks from violent criminals as male riders will simply shrug.

There aren't enough transit cops nor enough to pay them the overtime needed to protect female riders.

The women will be forced to either find other means of transportation, other places to live or work, or protect themselves like Bernie Goetz did.

Bring your earplugs riders...

I’m pretty sure that Fat Alvin is only interested in cases that have a political up-side for him. Prosecuting real crimes is uninteresting.

For me, this statement says that Penny's choke hold either contributed to or directly killed Neely. The question should not be if Penny's action contributed to the death of Neely. The question should be whether Penny was acting to protect passengers on the train from an erratic dangerous person - and were his actions purposely excessive?

Penny was trying to incapacitate a dangerous individual. How was Penny to know Neely's medical condition(s), which contributed to his death.

Yes. Bragg is showing his voters that he is tough on whitey. That’s the exact message this trial is sending.

This railroading of a decent man (and a fellow Marine) makes me sick to my stomach.

I believe this is a federal case so hopefully Trump has a way to quickly pardon him should the NYC jury not do the right thing here.

As one who works in NYC, I am often on subways and see the kind of mentally ill trash that often come on board the trains to harrass the other people. Usually it's relatively harmless and does not go beyond aggressive panhandling or trying to sell $5 candy bars that they probably shoplifted out of a Duane Reade store. This is why New York commuters have learned to jam in earphones and keep their eyes glued on their devices, pretending to ignore the riff-raff around them.

Fortunately I have not see anything really bad in a subway. I often wonder what my reaction would be if I saw a female commuter or tourist get physically harrassed by this scum. I'm quite sure my male protective instincts will kick in at that point and I'd be forced to take action, then quite possibly having my own life ruined by standing trial and having my life savings drained to pay for lawyers and such.

Hopefully I can retire before that situation arises (just a few more years!).
