Woman sues JetBlue after suffering injury from 'dangerously cold' ice cream sandwich

A New Jersey woman sued JetBlue for allegedly serving her a 'frozen solid' ice cream sandwich that caused her to fracture one of her front teeth.

Kiara Quinonez claimed the flight crew gave her a Nightingale brand strawberry shortcake ice cream sandwich during an August 20 flight from New York's JFK Airport to Charles De Gaulle Airport in Paris, France.

The lawsuit argued that the sweet treat was 'at a temperature below what is reasonable or safe for consumption' and Quinonez was not warned 'of the dangerously cold temperature and solid state of the ice cream sandwich she was served.'

According to the lawsuit, Quinonez sustained 'severe and permanent bodily injuries' from biting into the ice cream sandwich, adding that she continues to incur expenses for ongoing treatment.

She is being represented by Christopher S. Fraser of the Dweck Law Firm, who demanded a jury trial to determine how much JetBlue should pay for the alleged damages.

The product, as Madison Avenue could rightly point out, is an ‘ICE’ cream sandwich.

Could it get any clearer than that? They literally spelled it out for her.

The customer was contributorily negligent, but McDonald’s was certainly at fault. The store made the coffee something like 40 degrees hotter than they were supposed to so they wouldn’t have to make it as often if it cooled down. The woman was burned so badly it almost killed her and she needed skin grafts on her privates. They were on notice that their coffee was dangerously hot, but they kept choosing the lazy way.

IIRC she only wanted her medical expenses covered initially until McDonalds blew her off. It was not frivolous.

I heard JetBlue changed over to using cold outside air as a source to freeze their frozen food products. I would imagine temperatures at 30,000 feet makes for a really cold ice cream sandwich.

Safety?

Coffee is hot. Knives are sharp. Alcohol can kill you. And on and on and on. We do not live in a safe world as defined by the Liebeck lawsuit.

Safety was not the goal of that lawsuit. Going after deep pockets was their objective. And they succeeded.

Considering the small amount that McDonald’s first offered, I think it wound up a case of just compensation for the costs and suffering incurred.

Driving a car can kill you. Let me know when someone you love dies because the manufacturer of a vehicle didn’t ensure proper quality control.

Yes. People mocking that case or bringing it up by not knowing the actual details disturb me. What happened to that poor woman was unconscionable.

Stop selling coffee that you allow to get TOO hot.

(I doubt you brew coffee at home that gets to the point where it will cause 3rd degree burns.)

I believe if you wedge a collapsible disposable cup between your legs, you are assuming the risk of the consequences.

Coffee should be brewed just shy of boiling for best flavor. I run my church's coffee and doughnuts. I get good coffee and percolate it for the parishioners. One person (out of the thousands I served) requested that I unplug the percolator to make the coffee cool down. Many like the coffee piping hot. I let her know that we also have ice water and cold half & half and cold almond milk to cool down the coffee to her desired temperature. I also suggest our hot tea water for those who think I brew it too strong. Both too hot and too strong can be easily remedied. To cold or too weak . . . not so much.

Sometimes I get good suggestions. One lady asked for honey, and I told her that was a bit on the messy side. Then she suggested honey sticks. Perfectly reasonable, and we will add them.
