Woman sues JetBlue after suffering injury from 'dangerously cold' ice cream sandwich

A New Jersey woman sued JetBlue for allegedly serving her a 'frozen solid' ice cream sandwich that caused her to fracture one of her front teeth.

Kiara Quinonez claimed the flight crew gave her a Nightingale brand strawberry shortcake ice cream sandwich during an August 20 flight from New York's JFK Airport to Charles De Gaulle Airport in Paris, France.

The lawsuit argued that the sweet treat was 'at a temperature below what is reasonable or safe for consumption' and Quinonez was not warned 'of the dangerously cold temperature and solid state of the ice cream sandwich she was served.'

According to the lawsuit, Quinonez sustained 'severe and permanent bodily injuries' from biting into the ice cream sandwich, adding that she continues to incur expenses for ongoing treatment.

She is being represented by Christopher S. Fraser of the Dweck Law Firm, who demanded a jury trial to determine how much JetBlue should pay for the alleged damages.

If I didn’t have the common sense to wait a little for it to melt, I think I’d still prefer that to 3rd degree burns from hot coffee. It’s not like an ice cream sandwich is going to ‘spill’ on you. Just set it aside...

My guess would be that she had a bad tooth that finally quit and broke, and NOT from the ice cream.

She just saw that as a chance to win life’s lottery.

It would be interesting to know what her dental history is and whether or not decay played a role in the alleged break.

Not really. It was a frivolous lawsuit.

The verdict against McDonalds not only set in place warm coffee everywhere, but also blew tort reform policies completely away.

I just got a hangnail typing this reply. I’m gonna sue Logitech for a million or two.

She had 3rd degree burns and was in the hospital for a long time.

Do you believe that merchants don’t need to take any precautions or responsibility to ensure the safety of their products?
