“Seems like you want Penny to be charged with murder since you keep stressing how guilty he is.”

Seems like every time I comment on siuations like this presenting evidence, displaying sites, quoting laws and media presentations, it gets down to someone saying I am trying to do something to someone. Frankly I don’t cae if they toss him back or hang him. It seemed like an interesting topic and one I know something about.

Penny misapplied a lock fo way beyond the need and if you have any experience in this form of choke you would know it is a death sentence to apply it for over a couple of miniutes and numerous witnesses said it was over 15 minutes. I’m surprized he still had a heart beat when the cops arrived and took control. The oxygen starvation should have shut down his motor sensors of the brain before that. And if a man places this lock on another man properly and chokes him to death, no matter what the cause for applying it. he is responsible for the death. It is the law that says that, not me. And I told you where to get that statement. You got a problem with the law, email them.

Re: 13 - as you noted, it appears on the best available information he applied a lock and did not release well within an interval that has been established over years of use in LE, etc.

If so, he’s got problems. He owns his conduct and use of that lock. Hopefully he has good legal counsel.

“Frankly I don’t care if they toss him back or hang him.” So why bother to comment? We know what the law is. Doesn’t mean it’s right especially when it comes to race. “Email them”. Oh sure. Ever try it? Emails go directly to trash.

Two areas of the topic interest me. One I was involved with LE during my years attached to the USAF, the department of the army and the DOD. Over 35 years. I am concerned with the legalities of a situaion and not for the emotion of them. And secondly, I was a level four combatives instructor for the army and assisted for the navy and marines. That’s why I have some knowledge of the use and application of the BJJ lock they are discussing, rear naked choke. And when I read he was witnessed applying it for the time he did, it lead to my determination he had a problem as he should have released it long before he did..

And when someone starts to invent race into a decision, that is called segregation and has no place in the justice system. If there are situations built into a law, then it is a bad law. If it applies to everyone, it is closer to being good. No law is perfect as we have too many people that consider a law bad if it isn’t perfect and follows all their morals and agenda.

In his efforts to halt a bad situation, he made a huge mistake and not liking the guy that was killed doesn’t change the law. Penny misapplied the lock from the description by not releasing it before he did and damaged the brain. Intentional or not, it is faultable. And there are laws convering it. So there are three choices, like the law, disagree with the law, or try to get it changed to something better. But someone died and someone caused it and was at fault. Hence the law.

Gracie first brought BJJ into the US in the early 1970’s as a conditioning sport. It still is not the go to defence for many police departments. Marietta, Georgia, police, for instance didn’t bring it on line until 2019. And some never have staying with the Japanese arts aikido, Japanese judo, or Jiu Jitsu. The military, which could be where Penny was taught, started using BJJ in 2003.

“Hopefully he has good legal counsel.”

And he’ll need an understanding judge. I don’t see with all the witnesses that he can get out of responsibility for the act he took. But maybe with plea bargaining, or a judge sentencing using the circumstances, get off light. But with the racial tention being applied that has nothing to do with the case, he will have to be lucky to get light. Outside pressure.

I understand the law. The problem is the law is wide open to interpretation and given this is N.Y. they will bend it and shape it to their liking, just like they have done to Pres. Trump. Regardless, Penny took out a raving lunatic and in my book he’s a hero. Screw the law. End of story.

IF you ignore the law, then you are lowering your society. The only thing that makes the people different from the higher animals is our ability to reason. And part of that reasoning is the ability to establish rules in the best interest of the people.

There has always been a conflict between the ruling people and the ones not of that level of control. This is why one of the great things about the US during our expansion was that the federal government had little control of the laws of cities that made themselves because of their wish to rule their own lives. You made a good point that you didn’t like the interpretation of law in New York. You blame law enforcement but in actualities it is the people allowing a select few to run their lives. They elected them didn’t they? So until someone gets them out of office or gets with their neighbors and demands change, it will continue.

In this situation it is part of the Glooed Sameritan law. The law does not protect people who act with gross negligence or willful or wanton misconduct. In this case, gross negligence.

Again, this is N.Y. They make up there own laws. As in the case of Trump overvaluing assets. No one complained at the time, banks were paid, everyone was satisfied. So the crooked lawyers, prosecutor and judge made up their own figure of what the asset was worth, way below what would be reasonable. Penny will most likely be found guilty of murder, not to satisfy the law, but to satisfy the rioters. Just like the Floyd case. No more comment from me on this, you know where I stand. As far as I’m concerned Penny is a hero.
