Car Dealer Employee Convicted of Carjacking In Bad Repossession

The loan company had an agreement to cancel loans if the buyer missed one of the first two payments. The buyer's first payment on autopay bounced and he paid by a different method. His payments were up to date, but the dealer now owned the loan. The dealer sent an employee to repossess the car. The repo man showed the driver a gun and the driver surrendered his keys. The driver called the police saying he was carjacked. The repo man was arrested and explained what happened. However, he was still prosecuted and convicted of carjacking.

Threatening suicide with a gun is a crime, even when the repo is legitimate.

I think it was clear that the repo man threatened the driver with the gun, causing the driver to give him the keys to the car.

I saw it on a civil rights lawyer’s you tube site. Apparently the dealership guy, brandished a firearm too. Otherwise, they might have had a knock down, drag out fight, right by the side of the road.

Moral of the story: (1) Don’t repossess a car when the customer is current on payments and (2) Don’t repossess a car by brandishing a weapon and yelling at a driver to get out of the vehicle in the middle of the road.

I bought a car from a shady dealer in Memphis when I first joined the military. I was told by the military don’t buy from this dealership. I made payments for 6 months, was getting ready to transfer so I told the wife we’ll leave the keys in the car and didn’t make that months payment. Went home on leave came back and the car was gone and back at the dealership as planned. I told the wife it was a cheap 6 month rental and we transferred out!!

I think in most states if the car owner shows up during a repo, the repo man is supposed to leave the car.
